There is hereby established a program for the collection and separation of the items set forth in this section for recycling purposes, such collection and supervision shall be under the direction of the Superintendent of Public Works, who is hereby authorized and directed to establish rules and regulations for the separation and collection of the following items:
A. 
Newspaper.
B. 
Aluminum.
C. 
Glass.
D. 
Leaves.
E. 
Household batteries.
As used in this chapter, the following terms shall have the meanings indicated:
ALUMINUM
Recyclable aluminum cans.
CONSTRUCTION AND DEMOLITION DEBRIS
Concrete, brick, tree parts, nonferrous/ferrous metal, asphalt, corrugated cardboard.

FERROUS SCRAP
Pieces of metal or containers made exclusively or primarily of steel, tin-plated steel and composite steel.

GLASS
All products made from silica or sand, soda ash and limestone which are transparent or translucent and used for packaging or bottling of various matter and all other materials commonly known as "glass"; excluding, however, blue and flat glass, commonly known as "window glass."
HIGH-GRADE OFFICE PAPER
All computer paper, high-grade white paper, including letterhead, typing paper, copier paper, onionskin and notepad.

HOUSEHOLD BATTERIES
Household batteries include primary batteries which are not rechargeable such as carbon, zinc batteries, alkaline batteries, mercuric oxide batteries, silver oxide batteries, lithium batteries and zinc air batteries; secondary batteries which are rechargeable and are most commonly the nickel cadmium battery and small sealed lead-acid batteries not exceeding 25 pounds and generally found in cordless power tools, portable computers, cordless phones, camcorders and other such items. Car batteries are not considered as household batteries.

LEAVES
Any of the flat, thin expanded organs, usually green and growing, from the stems of trees, but turning brown and falling. Fallen leaves are only a problem during the months of September through December and then coped with as hereinafter set forth.
MIXED PAPER
Magazines, glossy inserts, computer paper, junk mail, colored paper and office paper.

NONRESIDENTIAL PROPERTY OWNER
The owner, occupant or operator of any commercial, industrial or institutional premises, including but not limited to business establishments, restaurants, warehouses, factories, office buildings, governmental premises and schools.

PLASTICS
All plastic containers coded as 1 and 2-HDPE, except plastic containers containing pesticide, motor oil and antifreeze which will not be accepted as recyclable materials.

RECYCLABLES
Those items required to be recycled under this chapter.

REGULATIONS
Includes such rules, implementation dates, schedules of times and such other requirements promulgated by the Superintendent of Public Works and approved by the Borough Council as may be necessary to carry out the purposes and objectives of this chapter.
SOLID WASTE
Includes all garbage and rubbish normally collected by regular, twice-weekly contract collection.
TIN
Tin cans used for the storage of food and beverages such as soups, vegetables, juices and sodas.

TREE PARTS
Unfinished wood from land-clearing projects, storm damage or pruning activities.

USED NEWSPAPER
Includes paper of the type commonly referred to as "newsprint" and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Expressly excluded, however, are all magazines or similar periodicals, as well as all other paper periodicals of any nature whatsoever.
WHITE GOODS
All large appliances such as washers, dryers, refrigerators.

YARD WASTE
Includes leaves, grass clippings and brush and included with "solid waste."[1]

All persons who are owners, lessees or occupants of residential property or commercial and institutional establishments in the Borough shall separate all recyclables from any other trash and garbage produced by any such residences and shall separately bundle or deposit the recyclables for pickup, collection and recycling, in accordance with all applicable regulations.
All separated recyclables shall be placed for pickup, collection and recycling in strict conformity with the following regulations:
A. 
Used newspapers, mixed papers, high-grade office paper and corrugated cardboard shall be separated and secured in bundles not to exceed 12 inches in height. Such bundles shall not be contained in plastic bags and shall not exceed 50 pounds in weight.

B. 
Aluminum shall be separated and secured in suitable reusable containers supplied by the owner, lessee or occupant.
C. 
Glass shall be separated by color and placed in suitable, reusable containers supplied by the owner, lessee or occupant. Containers constructed of paper or cardboard materials shall be deemed not suitable for this purpose.
D. 
Leaves, from September 1 through December 31, shall either be made available for collection by the Department of Public Works during its scheduled rounds of the streets of the municipality or properly bagged and left for collection, presumably by the scavenger. No more than five bags may be disposed of in this manner at any one time.
E. 
Tin shall be separated and secured in suitable reusable containers supplied by the owner, lessee, or occupant.

F. 
Type 1 and Type 2 plastics shall be separated and secured in suitable reusable containers supplied by the owner, lessee or occupant.

G. 
The Borough shall designate sites for the collection of household batteries. The Borough shall provide containers for the collection of household batteries at designated collection sites.

H. 
Ferrous scrap, construction and demolition debris (concrete, brick, tree parts, nonferrous/ferrous metal, asphalt, corrugated cardboard; where practical). Property owners, lessees and occupants must ensure that any contractors engaged by them separate and recycle such materials.

I. 
White goods shall be separated and recycled. Residential property owners, lessees and occupants may contact the Department of Public Works to schedule collection of white goods. Nonresidential property owners, lessees and occupants are responsible for the separation and recycling of white goods.

Any regulations promulgated by the Superintendent of Public Works shall be approved by the Borough Council and may be changed, modified, repealed or amended in whole or in part by majority vote of the Borough Council. A copy of such regulations as approved, modified, or amended shall be available for public inspection at the office of the Borough Clerk during regular office hours.
From the time of placement at the curb for pickup, collection and recycling, recyclables shall be the property of the Borough of Oradell or its duly authorized agent. No person unauthorized by the Borough of Oradell shall collect or pick up or cause to be collected or picked up any such recyclables. Each collection or pickup of recyclables in violation hereof from any one or more residences shall constitute a separate and distinct offense.
Anything herein to the contrary notwithstanding, any person who is an owner, lessee or occupant may donate or sell recyclables to any person, partnership or corporation, whether operating for profit or not for profit. Said person, partnership or corporation may not, however, under any circumstances pick up said recyclables from curbside in the Borough, whether or not said recyclables are placed at curbside on or immediately preceding regular curbside collection.
The Superintendent of Public Works and Department of Police hereby are authorized and directed to enforce this chapter. Any person, firm or corporation who violates or neglects to comply with any provision of this chapter or any regulation promulgated pursuant thereto shall, upon conviction thereof, be punishable by a fine not to exceed $200, except, however, in an initial conviction, the fine shall not exceed $10.
