Pursuant to the provisions of § 472 of the Labor Law of the
State of New York, as amended by Chapter 494 of the Laws of 1963 of the State
of New York, the Town of Niagara hereby assumes full responsibility
for enforcing the provisions of Article 17 of the Labor Law (relating to places
of public assembly) and the rules adopted thereunder by the Board of Standards
and Appeals of the Department of Labor of the State of New York or other agency
having jurisdiction.
The Code Enforcement Officer of the Town of Niagara is hereby designated
as the official responsible for such enforcement.
A fee as set forth from time to time by resolution of the Town Board
shall be charged to and collected from the owner, lessee or person conducting
a place of assembly for the approval of plans and for each inspection thereof
made pursuant to the provisions of the statutes aforesaid, but not more than
$200 in any one year may be so charged or collected, in respect of the same
premises; provided, however, that no fee may be charged to or collected from
a volunteer fire company or an organization of veterans for the inspection
of any place of public assembly owned and operated by such a volunteer fire
company or organization of veterans.
