Smoking is prohibited in all portions of the
following government buildings owned by Carneys Point Township: Carneys
Point Township Municipal Building, Carneys Point Township Construction
Code Office and Carneys Point Township Public Works Building.
As used in this chapter, the following terms
shall have the meanings indicated:
SMOKING
The burning of, inhaling from, exhaling the smoke from or
the possession of a lighted cigar, cigarette, pipe or any other matter
or substance which contains tobacco or any other matter that can be
smoked, or the inhaling or exhaling of smoke or vapor from any electronic
smoking device.

All places and buildings affected by this chapter
shall be posted with signs, to be exhibited at all entrances to each
building with letters at least one inch in height, stating SMOKING
PROHIBITED IN THIS BUILDING. The letters shall contrast in color with
the sign.
Any person violating any provision of this chapter
shall, upon conviction thereof, be punished by a fine not exceeding
$100.

No persons shall smoke within the boundaries of public parks,
playgrounds, ball fields, recreation and similar areas that are owned
or otherwise possessed by the Township of Carneys Point upon which
the public is invited or upon which the public is permitted and where
individuals gather for outdoor or recreational activities, including
all areas adjacent to the facilities, including, but not limited to,
the parking area or driveway. Areas covered by this prohibition will
be designated with "no smoking" signs.

This chapter shall be enforced by the Township Police Department.

Any person observed to be in violation of the provisions of
this chapter shall be issued a court summons and may be subject, at
the discretion of the court, to the following penalties:
A. A warning or fine not exceeding $50 for a first offense.
B. A fine not less than $50 but not exceeding $100 for a second offense.
C. A fine not less than $100 but not exceeding $200 for a third and
subsequent offense.
