As used in this chapter, the following terms shall have the meanings
indicated:
LIMOUSINE
Includes any automobile or motor car used in the business of carrying
passengers for hire to provide prearranged passenger transportation at a premium
fare on a dedicated, nonscheduled, charter basis that is not conducted on
a regular route and with a seating capacity in no event of more than 14 passengers,
not including the driver, provided that such a vehicle shall not have a seating
capacity in excess of four passengers, not including the driver, beyond the
maximum passenger seating capacity of the vehicle, not including the driver,
at the time of manufacture.
PRINCIPAL PLACE OF BUSINESS
The location of the main place of business of the limousine service
in the municipality where limousine service is conducted, where limousines
are dispatched, or where limousine drivers report for duty.
Any limousine owner or operator whose principal office or place of business
is located within the Township of Cinnaminson, must file with the Township
Clerk an insurance policy from a company duly licensed to transact business
under the insurance laws of the State of New Jersey in the sum of at least
$1,500,000 against loss by reason of the liability imposed by law upon every
limousine owner for damages on account of bodily injury or death suffered
by any person as the result of an accident occurring by reason of the ownership,
maintenance or use of the limousine upon any public street or highway throughout
the municipalities of the State of New Jersey.
The owner or operator of a limousine shall execute and file a power of attorney with the Division of Motor Vehicles of the State of New Jersey concurrently with the filing of the insurance documents with the Township Clerk as set forth in §
340-2. A copy of the executed and filed power of attorney shall be submitted to the Township Clerk.
The owner or operator of a limousine in the Township of Cinnaminson shall be required to pay a license fee to the Township Clerk as set forth in Chapter
265, Fees, annually for limousine license.
Upon satisfactorily demonstrating to the Township Clerk that all requirements mentioned in §§
340-2 through
340-5 have been met, an owner shall be entitled to obtain from the Township Clerk a limousine license. Licenses shall be issued annually expiring December 31 of each year. Licenses shall be issued in sufficient number to allow a license to be placed in each limousine operated by the licensee. Each limousine license shall identify the name of the insurance company filed with the Township Clerk, the amount of coverage and the expiration date of the insurance policy, a description of each limousine insured by the policy and the registration number of the vehicle licensed to operate as a limousine.
Any person, persons, firm, corporation, partnership or other entity
that violates any of the provisions of this chapter shall pay a fine, upon
conviction, of not less than $100 and not more than $500, be imprisoned for
not more than 90 days, or both.
