For the purpose of this chapter, the following terms, phrases, words
and derivations shall have the meanings given herein. When not inconsistent
with the context, words used in the present tense shall include the future;
and the words used in the singular number include the plural number. The word
"shall" is always mandatory and not merely directory.
GARBAGE
The putrescible animal and vegetable wastes resulting from the handling,
preparation, cooking and consumption of food.
LITTER
Garbage, refuse and rubbish, as defined herein, and all other waste
materials which, if thrown, deposited or blown, tend to create a danger to
public health, safety and welfare.
PERSON
Any person, firm, partnership, association, corporation, company
or organization of any kind.
PUBLIC PLACE
Any and all streets, sidewalks, alleys or other public ways and any
and all public parks, squares, spaces, grounds and buildings within the Township.
REFUSE
Any putrescible solid waste, including garbage, rubbish, ashes, street
cleanings, dead animals, scrap metal, machinery and any solid market or industrial
waste.
RUBBISH
Nonputrescible solid wastes consisting of both combustible and noncombustible
wastes, such as paper wrappings, cigarettes, cardboard, tin cans, grass, glass,
bedding, crockery, building materials and similar other waste materials.
TOWNSHIP
The Township of Cinnaminson, in the County of Burlington and State
of New Jersey.
No person while a driver or passenger in any vehicle shall throw or
deposit or place or cause to be placed, thrown or deposited or blown upon
any street or other public place within the Township of Cinnaminson any litter,
garbage, refuse or rubbish.
No person shall drive or move any truck or any vehicle within the Township
of Cinnaminson unless such vehicle is so constructed or loaded as to prevent
any load or contents of litter, ashes, garbage, refuse, rubbish or other waste
materials from being blown or deposited or falling upon any street, alley
or other public place in the Township. Nor shall any person drive or move
any vehicle or truck within the Township if the wheels or tires carry onto
or deposit in any street, alley or other public place mud, dirt, sticky substances
or foreign matter of any kind.

Every person who shall deposit litter, ashes, garbage, rubbish or refuse
at any sanitary landfill site duly licensed in the Township of Cinnaminson
shall transport such material to the site in a closed vehicle or a vehicle
in which such material is covered tightly by a tarpaulin or other appropriate
covering, or else all such materials shall be transported in such containers,
tightly fastened or transported in a vehicle so constructed or loaded as to
prevent any load or contents from being blown, deposited or falling from the
vehicle; it being the purpose of this section to provide for the transportation
of certain bulky type loads in vehicles where said load is not covered or
in covered containers which are fastened and kept in the vehicle in such manner
as the contents of the vehicle will not fall, spill over or blow out of the
vehicle.
All litter, garbage, refuse or rubbish or other materials being transported
within the Township of Cinnaminson which shall have blown, spilled or fallen
from such truck or vehicle while being carried or conveyed within the Township
of Cinnaminson, or while being loaded on or transported by any such truck,
vehicle or other container within the Township of Cinnaminson, shall be immediately
removed and broom-cleaned so as to leave the premises or street or public
way in a clean condition. The operator of any such truck or vehicle or the
person having control over any such container shall be responsible for removing
and cleaning as specified herein.

A. The garbage, refuse, rubbish or other materials may be collected along the streets within the Township which have not been dedicated and accepted by the Township as hereinafter set forth, and the cost thereof shall be reimbursed for the collection thereof for persons residing adjacent to such streets hereinafter designated, in accordance with N.J.S.A. 40:67-23.1, in the amount of the cost reasonably incurred, which amount is the sum per dwelling unit as set forth in Chapter
265, Fees.
(1) Designation: Westfield Drive, Sweetwater Drive and any
other roadway designated by the Township Committee by resolution duly adopted.
B. The reimbursement authorized under Subsection
A herein shall be to the persons residing adjacent to said streets or their officially designated representatives, and a list of said residents shall be on file with the Township Clerk, and the reimbursement shall be made quarterly upon proof of payment by the residents or their designated representatives. The proof of payment shall be a receipted bill from the resident or the duly designated representative.
C. Any provisions for reimbursement as provided herein shall
be subject to and conditioned upon the formal approval of the budget by the
Division of Local Government within the Department of Community Affairs of
the State of New Jersey. Failure of the state to so approve the municipal
budget of the Township of Cinnaminson because of the reimbursement provisions
set forth herein or for any other reason shall preclude the Township from
making any reimbursement in accordance herewith.

Any person who shall violate any provision of this chapter shall, upon
conviction, be punishable by a fine not exceeding $200 or by imprisonment
for not more than 60 days, or both, in the discretion of the Municipal Judge.
A separate offense shall be deemed committee on each day during or on which
a violation occurred or continued or for each separate violation hereof.
