There shall be a Manager appointed by the Council
pursuant to N.J.S.A. 40:69A-89. The Manager shall exercise the powers
and perform the duties of that office as required by law and shall
serve pursuant to N.J.S.A. 40:69A-93.
The Manager shall, pursuant to N.J.S.A. 40:69A-95:
A. Be the chief executive and administrative official
of the Borough.
B. Compile and submit to the Council the tentative annual
budget pursuant to law.
C. Execute all laws and ordinances of the Borough and
of the State of New Jersey.
D. Appoint and remove all department heads and all other
officers, subordinates and assistants for whose selection or removal
no other method is provided in this code or otherwise; supervise and
control his/her appointees; and report all appointments or removals
at the next meeting thereafter of the Council.
E. Review existing job classifications and salary ranges
of all employees, at least once annually and present recommendations
for any additions, changes or modifications therein to the Council,
at or before the second agenda meeting in the month of February of
each year.
F. Negotiate, but not approve or execute, contracts for
the municipality subject to the approval of the Council, make recommendations
concerning the nature and location of municipal improvements and execute
municipal improvements as determined by the Council.
G. Report to the Council any violations of the terms
or conditions of any statute, public utility franchise or other contract,
imposed in favor of the Borough or its inhabitants.
H. Attend all meeting of the Council with a right to
take part in the discussions, but without the right to cast a vote.
I. Recommend to the Council, for adoption, such measures
as he/she may deem necessary and expedient.
J. Keep the Council advised of the financial condition
of the Borough, by rendering a quarterly report within 30 days following
the end of the preceding quarter or a monthly report if requested
by the Council. The year end report should be submitted together with
the tentative budget.
K. Make an annual report to the Council, in writing,
at the last Council meeting of the month of February, of his/her work,
including a detailed list of major capital improvements considered
by him/her to be necessary or desirable during the succeeding five
years, for consideration of the Council in planning future undertakings.
L. Issue a written report at one Council meeting each
month concerning the activities of the Borough, its receipts and expenditures
and immediate planned activities of all departments.
M. Ensure that no contract be entered into or improvement
undertaken until the necessary funds have been appropriated in the
budget or by ordinance.
N. Consult with and work together with the Planning Board
in maintaining the Master Plan and in establishing plans for the future
development of the Borough.
O. Investigate at any time the affairs of any officer
or department of the Borough.
P. Develop administrative and operational rules, policies and operating procedures including, but not limited to, maintenance records where appropriate, as required by §
2-8, for the guidance of all departments and employees, in writing, to be reviewed by the Council, at least once annually and filed with the Clerk and with each department head.
Q. Act as purchasing agent of the Borough and install,
maintain and enforce a centralized purchasing system for all departments;
competitive bids will be solicited where required by state law, local
policy or where the Manager deems it appropriate, after discussion
with the Council.
R. Perform such other duties as may be required of the
Borough Manager by ordinance or resolution of the Council.
S. Prepare from time to time an organizational chart
of each department of the Borough.

A. During any absence of the Manager or in the event of his/her disability,
the Deputy Borough Manager shall exercise the powers and perform the
duties of that office.
B. Where the concurrent absence of both the Manager and Deputy Borough
Manager is temporary, such as vacation, seminars or brief illness,
the Acting Manager shall be selected by the Manager from any of the
department heads, except the Borough Attorney or Municipal Judge or
Chief Financial Officer. If the concurrent absence of both the Manager
and Deputy Borough Manager is prolonged for a period of 30 days or
more, the Council shall then determine the appropriate person to serve
as Acting Manager.
The Manager shall handle purchasing generally
pursuant to this section:
A. All purchases of any supplies, materials or equipment
or contractual services for a department shall be made by the purchasing
agent, following receipt of a written requisition from the head of
the department whose appropriation will be charged and the certification
of the Treasurer/Chief Financial Officer that a sufficient unencumbered
balance of appropriation is available to pay therefor. All purchasing
shall comply with the Local Public Contracts Law.
B. The head of each department shall designate, by writing
filed with the Manager, the name or names of employees in the department
authorized to receive supplies, materials and equipment. A person
so designated shall accept deliveries and sign for them, only where
the goods are in exact conformity with the order. Should there be
any doubt as to quantity or quality, the receiving employee shall
immediately notify the department head for appropriate action. If
any supplies, materials or equipment are rejected, the department
head shall immediately notify the Manager.
C. Except as the Manager may authorize in case of emergency,
no purchase shall be made and no bill, claim or voucher shall be approved
unless the procedures prescribed by or pursuant to the code have been
followed.
D. Emergency purchases. A purchase, contract or agreement
may be made without public advertising for bids notwithstanding that
the amount involved will exceed the current statutory limit under
N.J.S.A. 40A:11-3b when an emergency requires the immediate delivery
of the articles or the performance of the service and when prior to
the making of such purchase, contract or agreement, it is specifically
authorized by the Council, by resolution and all requirements of the
Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., are complied
with. If the nature of such emergency shall render impractical the
adoption of a resolution by the Council in advance, a resolution ratifying
such purchase, contract or agreement shall be adopted as soon thereafter
as is practicable. The resolution shall contain such other findings
and provisions as are required by the Local Public Contracts Law.
E. Vouchers and certification. No bill, demand or claim
shall be paid unless it contains a detailed statement of the items
or demand, specifying particularly how the bill or demand is made
up and a certification of the party claiming payment that it is correct;
nor shall any bill, claim or demand be paid unless the voucher on
which it is presented carries a certification of a department head
or of his/her duly designated representative having personal knowledge
of the facts, that the goods have been received by or the services
rendered to the Borough in accordance with the voucher.
The Manager may, in his/her discretion, allocate,
assign or delegate functions or powers to a department head for more
efficient administration of the Borough government, provided that
any such delegation, allocation or assignment shall not relieve the
Manager of any of his/her responsibilities under the charter or code,
nor shall it be inconsistent with any specific requirement of the
charter or code. Any such delegation shall be in writing and shall
be promptly reported to the Council and recorded in its minutes.
The Manager shall, through his/her office, provide
for reasonable assistance to citizens and other persons having business
with the Borough, promptly and in a courteous manner. He/she shall
be available to discuss complaints and recommendations with citizens
or groups of citizens and take such steps as he/she deems necessary
in each instance, thereby relieving the Council of routine complaints
and grievances, referring only such items to the Council as warrant
special attention or are matters of major importance. He/she shall
issue such public information and statements as are required to inform
the citizens of public information and statements as are required
to inform the citizens of public policies and actions.
The Manager shall in all matters act under the
direction and supervision and subject to the approval of the Council
and this code, except as otherwise provided by law.
The Borough Manager of the Borough of Fair Lawn
be and he/she is hereby authorized to execute requests for minor sewer
extension permits in the format as indicated on the form of the New
Jersey Pollutant Discharge Elimination System (NJDES) Supplement to
the Standard Application Form CP No 1.

There shall be a Deputy Borough Manager appointed by the Council
pursuant to N.J.S.A. 40:69A-90. The Deputy Borough Manager shall perform
the following duties:
A. During any absence of the Borough Manager or in the event of his/her
disability, the Deputy Borough Manager shall perform the duties and
responsibilities of the Borough Manager, pursuant to the applicable
provisions of the Administrative code of the Borough of Fair Lawn.
B. Under administrative direction of the Borough Manager, plans, directs
and, coordinates a variety of highly responsible and complex programs
and projects within the Borough.
C. Performs administrative work assisting the Borough Manager in the
management of the Borough, which work involves assisting in the direction
and supervision of all departments and other activities of the governmental
unit; may be responsible for providing assistance in special projects,
and the development and planning, research and other related functions;
general direction is received from the Borough Manager through conferences,
directives or discussion.
D. Acts as the Borough's website administrator, which duties include
but are not limited to reviewing website policies and procedures;
website professional services agreements, website budgetary items;
considering sitewide upgrades to website features/technologies or
changes in sitewide graphics; and evaluating questionable content
or external links for compliance with standards. The assignment of
specific responsibilities may be adjusted from time to time to meet
the needs of the Borough.
E. Assists in the preparation/distribution of Borough Employee Personnel
& Policies.
F. Assists in the preparation/distribution of Borough Standard Operating
Guidelines.
G. Acts as the Borough Manager's designee or liaison to boards, committees
or commissions of the Borough.
H. Prepares, establishes and maintains special reports, records, files
and documents as assigned by the Borough Manager
I. Edits and compiles public information releases in conjunction with
the Borough Manager.
J. Performs all other related duties and responsibilities as assigned
and approved by the Borough Manager.
