The owner of any building occupied as a residence by more than one family,
where the owner has agreed to supply heat, shall provide heat from September
of each year to July of each year so that the temperature of any apartment
or room used as a residence shall have sufficient heat necessary to maintain
an inside temperature of 70º F., or above, between the hours of 6:00
a.m. and 12:00 midnight; 65º F., or above, between the hours of 12:00
midnight and 6:00 a.m.
Every owner of a business establishment who permits to be occupied by
any business therein, under any agreement expressed or implied to supply or
furnish heat to the occupants thereof, shall supply heat from September 1
of each year to the next succeeding July 1 and every unit of space and every
habitable room therein shall be maintained at least 68º F. whenever the
outside temperature falls below 55º F. during daytime hours or other
hours of business operations. At times other than those specified, interiors
of units of habitable space shall be maintained at least at 55º F. whenever
the outside temperature falls below 40º F.
When the owner, agent or lessor of any building, dwelling unit or business
establishment is required to or shall have agreed to supply hot water, sufficient
water heated to at least 120º F. shall at all times be supplied.
If, by lease, a tenant of either dwelling or business establishment is required to provide heat, then and in that event, said tenant must comply with §§
117-2 and
117-3 above.
Any person, firm or corporation violating any of the provisions of this article shall, upon conviction thereof, be liable to the penalty stated in Chapter
1, General Provisions, Article
III.
