[Adopted 7-27-1982 as Sec. 17-1 of the 1981 Revised General Ordinances]
No person shall open a public street in the borough without first applying for a permit to do so and depositing a fee as set from time to time by resolution of the Borough Council[1] with the application. All applicants for permits shall further submit with the application a certificate of insurance from an insurance company authorized to do business in the State of New Jersey, with coverage of $50,000 to $300,000 for bodily injury and $50,000 property damage.

Application shall be made to the Borough Manager or his/her designee and shall state the location and purpose for which the street opening is required.
The following are required for street excavations:
A. 
Pavement edges shall first be cut to a straight line before the excavation begins. No opening shall exceed 10 square yards without special permission from the Borough Manager. Whenever the requested application for permit is for an opening exceeding 10 square yards, the same must be accompanied by four sets of plans and such additional deposit as shall be fixed by the Borough Manager to cover total estimated cost of pavement repair.
B. 
In making the excavation, the permittee shall be required to preserve the roadway from needless destruction and shall cause the excavation, installation or repair of utility and backfilling to be one continuous operation.
C. 
In the event the excavation is to extend the full width of the road in order to ensure the continuous flow of traffic, only 1/2 of said roadway shall be opened at any one time, which said opening shall be backfilled before the remaining half of said roadway may be opened.
D. 
Backfilling shall use 3/4 inch quarry processed stone (Q.P.) as the material for backfill. No more than six inches of material shall be backfilled at one time. The backfill material shall be thoroughly tamped with a vibratory compactor as the excavation is being filled. All excess material shall be removed from the roadway.

E. 
It shall be the responsibility of the permittee to properly guard the opening with adequate barricades and warning lights until the borough can make temporary restoration of the pavement, which restoration shall be completed no later than seven days after the opening has been backfilled.
F. 
The permittee shall be responsible for the installation of final pavement restoration. Restoration shall include the installation of HMA 19M6 base course four inches thick and HMA 9.5M64 surface course two inches thick on the prepared backfill material. The permittee shall be solely responsible for any and all damages which may occur as a result of the opening from the time the opening is made until such time that permanent restoration of the pavement has been made and approved. The permittee shall be required to make complete restoration on concrete or concrete base pavements.

No openings shall be made on Saturdays, Sundays or holidays unless an emergency exists and upon approval by the Borough Manager. No openings shall be left open for a period longer than one day, and no openings shall be left open over a weekend or a holiday, except where an emergency exists and upon approval by the Borough Manager.
Public utilities shall be excluded from posting a deposit but they shall apply for permits for any street openings and repairs to road surfaces and shall be strictly in accordance with regulations of the public works department.
