As used in this chapter, the following terms shall be construed to have the meanings indicated:
AGENT
Construed to mean (in the absence of instructions from the owner of any property or premises, or his/her duly authorized agent to the contrary) the occupant of any property or premises, insofar as his/her relations to the Department may be concerned, with respect to water uses and existing service.
BOARD
The Borough Council and its duly authorized representative.
CUSTOMER
Represents one service connection.
DEPARTMENT
The Water Department of the Borough of Fair Lawn, New Jersey.
MAIN or MAINS
Either in the singular or plural, all pipes other than service pipes, used for conveying water to or distributing water in the Borough.
METER RATES
Rates or prices to be charged for water, based upon the quantity consumed as measured by an approved water meter or as hereinafter set forth.
OFFICE
The office of the Department.
OWNER
Any person, firm, corporation or association actually owning any property or premises which is or can be prospectively supplied with water, or his/her duly authorized agent.
PREMISES
A building used or intended to be used for residential, business or other purposes, together with the land appurtenant thereto and such outbuildings as are used exclusively in connection therewith, or any part of such building with the land appurtenant thereto when sold as a separate unit.
SERVICE PIPE or SERVICE CONNECTION
A pipe connected to the main and extending thence to the curbline or into privately owned property or premises for supplying water thereto.
WATER DEPARTMENT OF THE BOROUGH OF FAIR LAWN
A division of the Public Works Department of the Borough, functioning under the direction of the Borough Council, either directly or by its duly authorized representative or agent, and the property, organization and operation of the water supply system and each and every part thereof of the Borough, collectively or separately.
The water mains and appurtenances, service pipes from main to curbline, corporation stops, curb stops and boxes of the Department shall be under the control of the Borough Council and its authorized agents and employees, and all other persons are forbidden to disturb, tamper with, injure, change, obstruct access to or interfere with the water mains and appurtenances, service pipes from main to curbline, corporation stops, curb stops and boxes in any way.
Fire hydrants are to be opened and used only by the Water or Fire Department of the Borough, or by such persons as may be specially authorized by the Department.
No person shall in any manner obstruct or prevent free access to, or tamper with, or injure, or damage by causing or permitting a vehicle to come in contact with any fire hydrant, or place or store temporarily or otherwise any object, material, snow, debris or structure of any kind within a distance of 10 feet from any fire hydrant. Any such obstruction, when discovered, may be removed at once, by the Department at the expense of the person responsible for the obstruction, and he/she shall be liable to a fine as herein provided. Repair of damage to hydrant shall be charged to person responsible.
Water for sprinkling, flushing or cleaning streets, or highways, sewers or catch basins shall be taken only from fire hydrants, or from such special standpipes or valves as may be provided for the purpose of the Department, and then only by such persons as may be duly authorized or licensed by the Department.
Curb stops shall be opened or closed only by authorized employees of the Department or by persons designated by the Department.
Service pipes between curb and meter likely to be exposed to freezing or other damage shall be effectively protected by the owner of the premises wherein the service pipes are located.
No person shall hinder or refuse to admit any Water Department officer, inspector, foreman or other authorized employee of the Department upon the presentation of the badge or other credentials provided by the Department, at all reasonable hours to any premises supplied with water from the Borough water supply system for the purpose of making an inspection thereof, including the examination of the entire water supply and plumbing system upon the premises.
The Department may, at its discretion, shut off the water from the premises of any owner or tenant guilty of violating any of the provisions of this chapter upon giving the owner or tenant at least 24 hours' notice of such intended action, in addition to the imposition of a fine as herein provided.
No person not an authorized officer or employee of the Department shall have, wear or exhibit any badge or credentials of the Department. It shall be the duty of each and every officer and employee of the Department, upon resignation or dismissal, forthwith to surrender and deliver at the office all badges or credentials of the Department. It shall be the duty of the clerk of the Department to keep a careful record of all badges.
Extensions to or changes in existing mains or the installation of new mains may be initiated by the Borough Council or by petition from property owners or citizens on the forms provided by the Department and addressed to the mayor and council of the Borough. The Borough Council shall prescribe the terms and conditions upon which such petition will be granted, and shall require the written acceptance and guaranty thereof by the applicant. If the petition is granted, work on the improvement will be begun as promptly as practicable.
All applications for the use of water or for a service connection shall be made in writing at the office of the Department by the owner of the premises or by his/her duly authorized agent, the fee for which shall be payable in advance.
All expenses incurred by reason of incorrect information given in an application shall be charged to and paid by the owner of the premises.
A. 
Service connection shall consist of tapping the water main, inserting the corporation stop, all excavating, backfilling of trench, obtaining a road opening permit to be the responsibility of the applicant.
B. 
Service line shall consist of laying of pipe from corporation stop to the curbline, providing curb stop and curb box with cover marked "water" and thence to the building or premises.
The Department will furnish labor and material for making the service connection as promptly as practical after application has been filed and all fees paid, and all other requirements hereinafter have been met.
The applicant shall be liable for the amount of water used in conformity with the schedule of rates as hereinafter provided.
A. 
The applicant for a service connection shall obtain the necessary road opening permits for State, county, and Borough roads.
B. 
The applicant shall pay all fees covering permits and costs of road repairs at current rates charged by state, county or Borough.
C. 
Applicant shall perform or have performed all excavating and backfilling trenches for service connection and service lines.
Any person, firm or corporation violating any of the provisions of this article shall, upon conviction thereof, be liable to the penalty stated in Chapter 1, General Provisions, Article III.
