The definition and regulatory provisions within
this article shall apply only to the handling of safety film, notwithstanding
any other provisions in this title to the contrary. As used in this
article, unless the context otherwise indicates, the following terms
shall mean and include:
A. "Safety film" shall mean any film made of a material
which has a safety rating equal to or better than the specifications
of the American Standards Association Method Number P1122, 31-1958,
or the latest revision or modification thereof, but shall not include
magnetic tape used for recording sound or videotape used for recording
pictures or sound or both.
B. "Film studio" or "shooting stage" shall mean any establishment
or area in a building in which music, speech or other sounds are produced
to be recorded for reproduction on safety film.
C. "Sound recording studio" shall mean any establishment,
room or area in a building in which music, speech or other sounds
are produced to be recorded for reproduction on safety film.
D. "Effects and titling studio" shall mean any establishment,
room or area in a building, in which safety film is used for the purpose
of preparing and photographing, for incorporation in any motion picture,
optical effects, titles or still picture inserts.
E. "Film exchange" or "depot" shall mean any establishment
or area in a building which is used for the handling, storing, inspecting,
projecting, rewinding or repairing of safety film in connection with
the distribution of safety film.
F. "Laboratory" shall mean any establishment area in
a building which is used for storage, perforating, printing, developing,
washing, fixing, assembling, polishing, finishing, projecting or other
operation connected with the production of pictures or sounds on safety
film.
G. "Screening room" or "Projection room" shall mean any
establishment or area in a building in which motion pictures, using
safety film, are displayed or exhibited to the trade and for which
no admission fee is charged.
H. "Premises," for the purpose of this regulation, shall mean only the area or building space where safety film is stored, used or handled within an establishment requiring a permit under this Article
IV.
Except as hereinafter provided, it shall be unlawful to use, store, have on hand, process or recover any safety film in any establishment or area or to conduct for commercial purposes a film studio, shooting stage, sound recording studio, effects and titling studio, film exchange, depot, laboratory, screening room or projection room without a permit. The storage and use in a theater or motion-picture theater of a motion-picture film used solely in a projection machine shall be exempt from the provisions of this Article
IV.
Any and all establishments requiring and granted permits under this Article
IV shall display a notice announcing that the establishment is a safety film establishment, together with a suitable warning that no inflammable or nitrate film is to be allowed on the premises unless conforming to the provisions of this section and also with a notice prohibiting smoking in all storage and manufacturing areas.
All electric lighting and wiring shall be as
prescribed by the applicable provisions of the Electrical Code of
the Borough.
All applications for all permits shall be made to the Fire Prevention Bureau of the Borough setting forth the name and address of the applicant, the full details on the type of work to be conducted on the premises to be licensed, a full and complete description of the buildings to be used and the work to be conducted therein, and the name and address of the person in charge of the premises. The Fire Inspector shall immediately, upon the filing of the application to the Bureau, inspect the premises to be licensed, and if the premises meet with the provisions of this Article
IV and all other rules and regulations of the Borough, the permit shall be issued upon payment of the following fees: $1 for every 100 square feet of area per floor or part thereof.
This Article
IV shall in no way affect the provisions of the Zoning Ordinance of the Borough.
