The Director of the library be and is hereby empowered and authorized
to file a complaint against any patron of the library who fails to return
a book or other article which was borrowed from the library.
No such complaint shall be filed unless:
A. The library has caused to be sent by regular mail to
the borrower or the borrower's parents, if the borrower is a minor, a letter
informing the borrower that the article or articles are overdue and further
informing the borrower of the provisions and sanctions of this chapter; and
B. Thirty days have elapsed from the date the letter was
mailed and during such period of time the library has not received either
the book or other article which is overdue or the replacement value of the
book or other article.
In the event that a borrower has lost the book or other article which
is overdue, the borrower shall only be liable for the replacement value of
the book or other article.
Any person violating any provision of this chapter shall, upon conviction
thereof, pay a fine of not less than the replacement value of the book or
other article not returned to the library, plus an amount up to $150, plus
court costs.
