It is unlawful to leave an animal on a road, in a public place, or on private property with the intent to abandon the animal, unless the animal is a community cat being released as part of an approved trap-neuter-return program approved by the Animal Control Authority, in which event the animal may be released on private property with the consent of its owner.
It is unlawful to willfully give or expose carbon monoxide or other poison or ground glass to an animal with the intent that an animal ingest it, except that an owner may mercifully put to death the owner's domestic animal or deliver it to the Animal Control Authority for disposition.
A. 
Animals must be provided with:
(1) 
Sufficient food and water that is free from contamination;
(2) 
Proper air and ventilation;
(3) 
Space for exercise sufficient for the species;
(4) 
Veterinary care when needed to provide treatment and to prevent suffering;
(5) 
Humane care and treatment;
B. 
Required shelter for domestic animals.
(1) 
A domestic animal shall be brought inside a home or building within 30 minutes of the onset of and during the following conditions unless the animal has continuous access to suitable shelter:
(a) 
The ambient temperature is 32° F. or below in the immediate vicinity of an animal. In addition to other cold weather or precipitation-related environmental conditions, including, but not limited to, wind chill factor, rain, snow, ice, sleet or hail, that a person should reasonably conclude would pose an adverse risk to the health or safety of an animal, based on the animal's size, age, physical condition, or thickness of the animal's hair or fur; or
(b) 
The ambient temperature of 90° F. or above in the immediate vicinity of an animal. In addition to other environmental conditions, such as direct sunlight, heat index or hot pavement, or any other hot surface, that a person should reasonably conclude would pose an adverse risk to the health or safety of an animal, based on the animal's size, age, physical condition, or thickness of the animal's hair or fur; or
(c) 
The National Weather Service issues a severe weather alert, and the forecasted weather is such that a person should reasonably conclude that the weather would pose an adverse risk to the health or safety of an animal, based on the animal's size, age, physical condition, or thickness of the animal's hair or fur.
(2) 
The owner of an animal that is not regularly kept within a home or building shall provide the animal with suitable shelter to protect it from the wind, snow, rain, cold, and sunlight.
(3) 
The shelter shall have a floor appropriate to protect from flooding, a roof, and four walls, one of which shall contain a doorway.
(4) 
The space available to the animal in the shelter shall be:
(a) 
Large enough for an animal to stand to its full height, turn around, lie down, and make normal postural adjustments comfortably.
(b) 
Maintained in a safe and healthful manner, free of standing water, accumulated waste and debris, protected from flooding, and provided with adequate ventilation to allow the animal to remain dry and maintain a normal body temperature and exposure to natural or artificial light and free from extreme and unreasonable objectionable odor.
(5) 
The shelter provided to an animal may not include a crawl space under or inside of a building or part of a building, the space under or inside of a vehicle, any structure made from pressure-treated wood which contains the chemicals arsenic or chromium, or a floor consisting of wire or chain-link, or any structure made from cardboard or other materials that are easily degraded by the elements.
C. 
It is unlawful to leave animals unattended in a parked vehicle without sufficient ventilation that is adequate to prevent the animal from suffering physical distress from heat exhaustion. If an animal is found to be in distress by an Animal Control Officer or law enforcement, the Animal Control Officer or law enforcement officer has the right to remove the animal by any means necessary.
D. 
If a violation of this section occurs, the victim animal may be impounded by the Animal Control Authority until the owner has complied with this section and has satisfied the release provision stated in § 133-16. If the owner fails to do so within 10 days after being notified or becoming aware of the impoundment, the animal may be disposed of by the Animal Control Authority in accordance with that section.
