Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383; N.J.S.A. 52:27D-202), the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et seq.) shall be locally enforced in the Borough of Haddonfield.

The local enforcing agency shall be the Office of the Haddonfield Fire Marshal of the Borough of Haddonfield. The Haddonfield Fire Marshal’s Office shall hereinafter be known as the “local enforcing agency.”

A. 
The local enforcing agency shall be under direct supervision of the Fire Official of the Borough of Haddonfield. He or she shall provide monthly or annual reports, as requested, to the Chief of the Fire Department, the Borough Administrator and the Director of Public Safety of the Borough of Haddonfield.
B. 
The Fire Official and other employees of the local enforcing agency shall be appointed and removed in accordance with the personnel laws, regulations, ordinances, resolutions, policies, and procedures governing Borough of Haddonfield employees.

A. 
The local enforcing agency shall enforce the Uniform Fire Code in all buildings, structures, and premises within the established boundaries of the Borough of Haddonfield other than:
(1) 
One- and two-unit owner-occupied dwellings, wherein the owner must occupy one of the two units, used exclusively for dwelling purposes; and
(2) 
Buildings, structures and premises owned or operated by the federal government, interstate agencies or the state.
B. 
The local enforcing agency shall faithfully comply with all pertinent requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

The local enforcing agency established by § 114-2 of this chapter shall carry out the periodic inspections required by the Uniform Fire Code on behalf of the New Jersey Commissioner of Community Affairs.
Pursuant to N.J.A.C. 5:70-2.16 and 5:70-2.19 of the Uniform Fire Code, any person aggrieved by any order of the Fire Official shall have the right to appeal to the Construction Board of Appeals of Camden County.

In addition to the registration fees required pursuant to the Act (for life-hazard uses), registration and fees shall be required for non-life-hazards and shall be billed and collected at the expense of the Fire Official, as per the inspection fee schedule below. The fees shall be paid within 30 days of notification or shall be considered delinquent. The Borough of Haddonfield shall then take the necessary legal steps to compel payment.
A. 
Residential Use Group (includes buildings with dwelling units not listed as life hazard by the New Jersey Bureau of Fire Safety, except one- or two-family owner-occupied units).
(1) 
One to three units: $50.
(2) 
Four to 10 units: $100.
(3) 
Eleven to 20 units: $150.
(4) 
Twenty-one to 40 units: $200
(5) 
Each additional 20 units or fewer: $50.
B. 
Commercial or Industrial Use Group (includes all buildings not listed as life-hazard or residential buildings by the New Jersey Bureau of Fire Safety). [Please note: Each floor or story shall be calculated as separate areas for total building calculation.]
(1) 
Building with or without attached dwelling units not in excess of 1,000 square feet: $50.
(2) 
Building with or without attached dwelling units in excess of 1,000 square feet not exceeding 3,000 square feet: $75.
(3) 
Buildings in excess of 3,000 square feet not exceeding 9,000 square feet: $100.
(4) 
Buildings in excess of 9,000 square feet not exceeding 15,000 square feet: $200.
(5) 
Buildings in excess of 15,000 square feet not exceeding 50,000 square feet: $250.
(6) 
Buildings in excess of 50,000 square feet not exceeding 100,000 square feet: $300.
(7) 
Buildings in excess of 100,000 square feet not exceeding 200,000 square feet: $600.
(8) 
Buildings in excess of 200,000 square feet not exceeding 300,000 square feet: $800.
(9) 
Additional 100,000 square feet or part thereof: $300.
C. 
Certificate of Fire Code status.
(1) 
The fee for any structure requiring inspection not covered under either the life-hazard fee schedule or the non-life-hazard fee schedule shall be: $50.
(2) 
The following buildings or structures, if classified as non-life-hazard, although not exempt from registration or inspection, will be exempt from paying an inspection fee as pursuant to the Act:
(a) 
Municipal-owned buildings.
(b) 
Fire stations.
(c) 
EMS stations.
(d) 
Houses of worship (excluding rooms for public assembly, i.e., meeting halls, social halls, rental halls).
D. 
Firesafety permits. The cost of firesafety permits shall be as set forth in N.J.A.C. 5:70-2.9(c).
E. 
Fire report. The fee established for copies of Fire Marshal investigation reports to insurance companies/owners or occupants shall be $35.

Certificates of Fire Code status as established by the Uniform Fire Code, shall be issued by the Fire Official if the application is in compliance with the Uniform Fire Code and any other local, state or federal law or regulation, after payment of the application fee of $40 to the Borough of Haddonfield.
A. 
Fire reports. Fees established for copies of fire reports from the Haddonfield Fire Department to any concerned party requesting same shall be $15 and must be paid to the Borough of Haddonfield, in advance. Exception: The fee will be waived to Haddonfield Borough residents for reports involving their primary residence. In addition, if photographs are requested, a cost of $1 per print, or the actual cost, whichever is greater, must be paid. The fees will be waived for governmental law enforcement agencies.
B. 
Sale or rental of property certificate of compliance.

(1) 
Prior to the rental, sale and settlement of any residential dwelling, the property shall be inspected by the Borough of Haddonfield Bureau of Fire Prevention for compliance with the following smoke detector, carbon monoxide alarm, fire extinguisher and visible house number requirements, as per National Fire Protection Agency (NFPA) 74-1984, as amended and supplemented, whereupon a certificate of compliance will be issued:
(a) 
Any one- and two- family dwelling containing at least one residential dwelling unit must have at least one smoke detector alarm, in satisfactory working order, on each level of the building or the applicable NFPA standard at the time of the inspection. All single-station battery-operated smoke alarms shall be of the ten-year sealed battery type and listed by ANSI/ UL 217, effective January 1, 2019.

(b) 
Any one- and two-family dwelling containing at least one residential dwelling unit must have at least one carbon monoxide alarm installed and in working order or the applicable NFPA standard at the time of inspection. This requirement does not apply to such units in buildings that do not contain a fuel-burning device or have an attached garage.
(c) 
Any one- and two-family dwelling containing at least one residential dwelling unit shall have placed upon or in front of the portion of building facing the street the proper street address number as assigned by the Borough of Haddonfield. Such number shall be of sufficient size (minimum four inches) and in such a location as to be easily seen (contrasting colors) and read from the street.[1]

(d) 
Any one- or two-family dwelling, other than a seasonal rental, shall be equipped with at least one portable fire extinguisher in conformance with rules and regulations promulgated by the Commissioner of Community Affairs pursuant to the Administrative Procedure Act, P.L. 1968, c. 410 (N.J.S.A. 52:14B-1 et seq.).

For the purposes of this section, "portable fire extinguisher" means an operable portable device, carried and operated by hand, containing an extinguishing agent that can be expelled under pressure for the purpose of suppressing or extinguishing fire, and which is:
[a] 
Rated for residential use consisting of an ABC type;
[b] 
No larger than a ten-pound rated extinguisher; and
[c] 
Mounted within 10 feet of the kitchen area, unless otherwise permitted by the enforcing agency.
[2] 
"Season rental unit" means a dwelling unit rented for a term of not more than 125 consecutive days for residential purposes by a person having a permanent residence elsewhere, but shall not include use or rental of living quarters by migrant, temporary or seasonal workers in connection with any work or place where work is be performed.
(e) 
Failure to comply with Subsection B(1)(a), (b), (c) or (d) shall result in a summons issued by the Borough of Haddonfield and shall be subject to a penalty as provided in § 114-9 of this chapter.
(2) 
Fees and waivers.

(a) 
The fee for this inspection, made payable to the Borough of Haddonfield, shall be as follows:

If the application is submitted more than 10 business days prior to settlement or change of occupancy for rental property the fee is $45.
[2] 
If the application is submitted four to 10 business days prior to settlement or change of occupancy for rental property the fee is $90.
[3] 
If the application is submitted fewer than four business days prior to settlement or change of occupancy for rental property the fee is $161.
[4] 
If the property does not comply with the requirements, one reinspection will be made at no additional charge. However, additional reinspections will require a prepaid fee of $25 for each reinspection.
(b) 
A waiver of this fee and inspection will only be authorized for the sale of a newly constructed home within 60 days of the issuance of a certificate of occupancy by the Construction Official.
