The Township of Hillsborough has filed a written consent with the New Jersey Department of Transportation that the provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at the Hillsborough Township Municipal Complex located in the Township of Hillsborough, County of Somerset, and the following regulations shall be enforceable:
A. 
All vehicles must park only in designated areas and between the lines provided.
B. 
Handicapped parking. All stalls are shown on the latest striping and signage plan and signed with R7-8 ("Reserved Parking" sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

Effect of article. If any part of this article is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of the article.

Hillsborough Township park-and-ride-facility located at Block 178, Lot 3.02, more commonly known as the south side of Amwell Road between Route 206 and Estate Drive, is hereinafter designated as Park-and-Ride Lot "A."
A. 
Regulations.

(a) 
All vehicles must park in designated areas and between the lines provided.

B.

(1) 
The site plan originally produced on July 2, 1996 by Paul M. Sterbenz of Maser Sosinski & Assoc. and subsequently marked up by Mark Hiestand of the NJDOT on October 26, 2001, to delineate the areas regulated by § 143-81A is hereby approved and adopted as an official finding and record of the location and areas within the Park and Ride Lot "A" which are to be used for permit parking, nonpermit parking, handicapped parking and other parking and traffic regulations as contained in § 143-81A and shall hereinafter be referred to as the "Site Plan for Park and Ride Lot "A."
(2) 
The site plan for Park and Ride Lot "A" approved and adopted pursuant to this section shall continue to constitute an official finding and record as to the location and boundaries of the areas regulated by § 143-81A until such time, if any, that this section shall be amended to reflect any additions or deletions of the regulated portions of Park and Ride Lot "A." The Township Clerk is hereby directed to receive and to keep on file the original of the site plan for Park and Ride Lot "A" approved and adopted pursuant to this section.
(3) 
The following additional matters are hereby determined, declared, recited and stated: It is understood that the site plan for Park and Ride Lot "A" was prepared and is intended to be used as evidence in prosecutions arising under the laws of this state, and the ordinances of this Township, and that such site plan shall constitute prima facie evidence of the location and boundaries of areas which are regulated by § 143-81A. Further, a prosecutor is not precluded from introducing or relying upon any other evidence or testimony to establish a violation of the offense defined in the laws of this state and the ordinances of this Township, including use of a map or diagram other than the one approved and adopted pursuant to this section.
C. 
Violations.
(1) 
Any person violating the provisions of this section shall upon conviction for a first offense be punished by:
(a) 
A fine not to exceed $100; and/or
(b) 
A sentence of community service of not more than 15 days.
(2) 
Any person violating the provisions of this section shall upon conviction for a second offense be punished by:
(a) 
A fine not to exceed $200; and/or
(b) 
A sentence of community service of not more than 15 days.
(3) 
Upon the second violation of the provisions of § 143-81A(1)(c) the vehicle will be towed and impounded at the owner's expense.
D. 
Severability. If any provisions of this article are found to be invalid for any reason by the final judgment of a court of competent jurisdiction, the validity of such portions shall not affect the validity of the remaining provisions of this chapter, which shall be severable therefrom.

A. 
Definitions. Definitions as used in this section shall have the following meanings:
CHARGING STATION
A location that is fitted with electric charging equipment.
CHARGING STATION EQUIPMENT
The conductions, including underground and grounded, and the electric vehicle connectors, attachment plugs, and all other fittings, devices, power outlets, charging status or apparatus installed specifically for the purpose of delivering electrical energy from the charging station to the electric vehicle.
CHARGING STATION SPACE
A dedicated, marked and signed parking space that is fitted with charging station equipment and exclusively used for the charging of electric vehicles.
ELECTRIC VEHICLE
Any vehicle that is licensed and registered for operation on public and private highways, roads, and streets, and operates either partially or exclusively using an electric motor powered by an externally changed on-board battery.
ELECTRIC VEHICLE SUPPLY/SERVICE EQUIPMENT ("EVSE")
The equipment, including the cables, cords, conductors, connectors, couplers, enclosures, attachment plugs, power outlets, power electronics, transformer, switchgear, switches and controls, network interfaces, point of sale equipment, and associated apparatus designed and used for the purpose of transferring energy from the electric supply system to to a plug-in electric vehicle. "EVSE" may deliver either alternating current or, consistent with fast charging equipment standards, direct current electricity. "EVSE" is synonymous with "electric charging vehicle charging station."
PUBLICLY ACCESSIBLE
EVSE that is available for use by the general public.
B. 
Scope. This section shall pertain to the electric vehicle charging stations known as electric vehicle supply/service equipment located at Hillsborough Township municipal properties. EVSE parking spaces shall be reserved for parking and charging electric vehicles only. Publicly accessible EVSE parking spaces located on municipally owned properties shall be monitored by the municipality's Police Department and enforced in the same manner as any other parking. It shall be a violation of this section to park or stand a nonelectric vehicle in such a space or to park an electric vehicle in such a space when it is not connected to the EVSE. Any nonelectric vehicle parked or standing in an EVSE parking space or any electric vehicle parked and not connected to the EVSE shall be subject to the penalty provisions of § 143-4 and the towing/impoundment of the offending vehicle at the vehicle owner's expense. Signage indicating the penalties for violations shall comply with Subsection C below. Any vehicle parked in such a space shall make the appropriate payment for the space and observe applicable parking time limits.
C. 
Signs. EVSE parking spaces shall have posted regulatory signs allowing only charging electric vehicles to park in such spaces. For purposes of this section, "charging" means that an electric vehicle is parked at an EVSE and is connected to the EVSE. Regulatory signs shall be installed immediately adjacent to and visible from the EVSE. All regulatory signs comply with visibility, legibility, size, shape, color, and reflectivity requirements contained within the Federal Manual on Uniform Traffic Control Devices as published by the Federal Highway Administration. In addition to the signage described above, the following information shall be available on the EVSE or posted at or adjacent to all publicly accessible EVSE parking spaces: hour of operations; time limits; tow-away provisions; usage fees; parking fees; and contact information (telephone number) for reporting when the equipment is not operating or other problems.
D. 
Usage fees. The rate for charging electric vehicles shall be $1.50 per hour for the first three hours. After the first three hours, the fee shall be $5 per hour.
E. 
Violations. It shall be unlawful for any person to park or leave a vehicle in a space designated for the recharging of electric vehicles unless the vehicle is connected for electric charging purposes. Any person violating the provisions of this section and/or the owner of the vehicle shall be subject to the penalty provisions of § 143-4 and the towing/impoundment of the offending vehicle at the vehicle owner's expense.
