The issuing authority for the Township of Hillsborough responsible
for approving bingo and raffle licenses shall be the Township Clerk.
No bingo games in which cash or merchandise
shall be offered as a prize shall be conducted on the first day of
the week, commonly known and designated as Sunday.

A. No raffle or other game of chance in which cash or
merchandise shall be offered as a prize shall be conducted on Sundays,
unless it shall be specifically permitted in the license for the holding,
operation and conducting of such raffle or game of chance issued by
the Township of Hillsborough Clerk.
B. The applicant for a license to conduct a raffle or
other game of chance who desires permission to conduct such raffle
or game of chance on Sundays must specifically request such permission
in its application, must specify the type and nature of the game for
which such permission is sought and must demonstrate good cause for
the issuance of such special permission.
C. Any applicant who fails to specifically request such
special permission or fails to demonstrate good cause for the issuance
of such special permission shall not be permitted to conduct such
games on Sundays.
D. The Township Clerk may, in his or her discretion and for good cause shown and subject to the conditions set forth in Subsection
E below, issue a license to conduct raffles or other games of chance which would permit the conduct of raffles and other games of chance on Sundays.
E. Licenses permitting raffles or other games of chance
on Sundays may be issued only to qualified nonprofit organizations,
and no organization may be granted permission to conduct such raffles
or other games of chance on more than one Sunday in any calendar year.

The applicant shall comply with and is subject
to regulation in accordance with the State Raffles Licensing Law,
N.J.S.A. 5:8-50 et seq. and the rules promulgated thereunder by the
State Gaming Control Commission.

The applicant shall pay the following licensing
fees for the conducting of raffles to the Township of Hillsborough:
A. On-premises draw raffle for cash prizes (50/50) of
less than $400 or merchandise prizes where the total combined retail
value of prizes awarded is less than $400: no licensing fee. In the
event the retail value of the prize offered or awarded exceeds $400
in a raffle in which it was anticipated that the retail value would
not exceed $400, the licensee shall submit a check or money order
in the amount of $10 at the time of filing the Report of Operations
required by N.J.A.C. 13:47-9.
B. On-premises draw raffle for cash prizes (50/50) in
excess of $400 or merchandise prizes where the total combined retail
value of prizes awarded is in excess of $400: $10 for each day on
which a drawing is to be conducted under the license.
C. Off-premises draw raffle awarding merchandise as a
prize: $10 at the time the application is submitted.
D. Carnival games or wheels: $10 for each game or wheel
held on any one day or any series of consecutive days not exceeding
six at one location.
E. Off-premises cash (50/50) raffle: $10 at the time
the application is submitted.
F. Calendar raffle awarding cash or merchandise as a
prize: $10 at the time the application is submitted.
G. Instant raffle games awarding cash or merchandise
as a prize:
(1) Ten dollars for cash or merchandise offered for sale.
(2) Five hundred dollars for a one-year license to sell
or to offer for sale instant raffle tickets during that year.
H. Golf hole-in-one contests: $10 for each day on which
the contest is held.

The license fees set forth in §
177-4 shall not apply to any senior citizen association or club registered with the State Gaming Control Commission which will hold, operate or conduct the games solely for the bona fide active members of the licensed association or club. No fee shall be charged to any senior citizen association or club for processing an application or issuing a license to hold, operate or conduct any legalized game of chance solely for its bona fide active members.

The Township Committee, pursuant to N.J.S.A. 5:8-30 and N.J.S.A.
5:8-57, may suspend and revoke any issued bingo or raffle license,
after a hearing, for any violation of this chapter or applicable law.
The Township Committee may suspend the operation of a bingo or raffle
pending hearing, in which case a hearing must be held within five
days after such action. Notice of a hearing shall be served personally
upon an officer of the licensee or the member in charge of the conduct
of the bingo or raffle or sent by registered mail or certified mail
to the licensee at the address shown on the license. All decisions
and findings by the governing body regarding the suspension or revocation
of a bingo or raffle license shall be in writing.
