The Township of Hillsborough will provide snow removal, cindering, sanding and salting services on those streets hereinbefore mentioned,[1]  out of consideration for public health, welfare and safety.

“WHEREAS certain streets located in Hillsborough Township have been dedicated to public use; and   
“WHEREAS these streets have not been approved nor accepted by the Township of Hillsborough due to the failure of these streets to comply with municipal standards; and   
“WHEREAS certificates of occupancy have been issued to home owners of property fronting on said streets, which homeowners presently reside thereon; and  
“WHEREAS the Township of Hillsborough wishes to provide those homeowners with the same or similar snow removal services as other landowners located in the Township; and   
“WHEREAS although the responsibility for snow removal from the said streets rests with the subdividers of the subdivisions wherein the aforesaid streets are located, but it appears that some of said subdividers are not carrying out their responsibilities in this regard; and  
“WHEREAS there is a need for snow removal out of consideration for the public safety and welfare and to permit the passing of emergency and other vehicles; and   
“WHEREAS there is a need for the use of cinders, sand and salt to alleviate ice and/or snow conditions out of consideration for the public safety and welfare and to permit the passing of emergency and other vehicles; and  
“WHEREAS the Township intends to obtain reimbursement of any costs incurred by the municipality for said snow removing, cindering, sanding or salting from said subdividers of said subdivisions wherein the aforesaid streets are located;   "NOW, THEREFORE BE IT ORDAINED. . ."
The Township Committee is hereby authorized to obtain the services of independent contractors when it deems the same is necessary to provide snow removal, cindering, sanding and salting services on the streets aforesaid[1] when proper snow removal, cindering, sanding and salting services have not been performed within a reasonable period of time by the subdivider responsible therefor.

The cost of said snow removal, cindering, sanding and salting services, whether incurred by expenditure to independent contractor or incurred as a result of the use of Township vehicles, personnel and material, shall be immediately billed to the subdivider responsible for said snow removal, cindering, sanding and salting services, and in the event said bill is not paid within 30 days from its transmittal, it shall become a lien upon the real property owned by said subdivider within the municipality.
A. 
Each subdivider shall annually in September supply to the Township Clerk the name, address and telephone number of the person whom said subdivider has engaged for the purpose of said snow removal, cindering, sanding and salting services on the streets aforesaid within his subdivision and who is responsible for the plowing of snow, cindering, sanding and salting on said streets.
B. 
The failure of a subdivider to provide such name to the Township Clerk shall raise a presumption that the subdivider does not intend to plow, cinder, sand and salt the streets aforesaid within his subdivision.
Nothing in this article shall constitute, nor does the Township intend to imply by this article, acceptance of the dedicated streets which have not as of this time been accepted in the subdivision in which the aforesaid streets are located.
