The provisions of Chapter 12, Construction, Operation and Maintenance of Retail Food Establishments, of the New Jersey State Sanitary Code are hereby recognized as being of full force and effect in the Township of Hillsborough.
A. 
No person shall operate a retail food-handling establishment, as defined in and governed by said Chapter 12 of the State Sanitary Code, unless a license to operate the same shall have been issued by the Hillsborough Township Board of Health. Such license shall be posted in a conspicuous place in such establishment.
B. 
The fees to be charged for such licenses shall be as follows:
(1) 
For permanent retail food establishments with less than five employees: $50.
(2) 
For permanent retail food establishments with more than five employees: $100.
(3) 
For temporary retail food establishments (open less than five days a week or seasonal): $25.
C. 
Licenses issued under the provisions of this chapter shall expire annually on December 31 of the year of issuance, and application for renewal thereof shall be submitted, together with the required fee, prior to January 31 of the following year.
D. 
A license may be suspended or revoked for a violation by the holder of any provision of this chapter or said Chapter 12 of the State Sanitary Code, after an opportunity for a hearing by the Board of Health or its authorized representative.
E. 
A license is not transferable.
Any person, violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be deemed guilty of a Class C violation, punishable as provided in Chapter 291, General Provisions, Board of Health, Article II.
