[HISTORY: Adopted by the Township Council of the Township of Jefferson 9-4-1996 by Ord. No. 13-96 (Ch. 16, Art. I of the 1967 Code). Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
BOARD OF EDUCATION PROPERTIES
All lands and grounds owned by the Jefferson Township Board of Education, including but not limited to all recreation fields, parking areas and grounds adjacent to the buildings owned and operated by the Board of Education.

ENCLOSED AREA
All areas between a floor and a ceiling extending to the outer perimeter walls of a structure.
HASHISH
The resin extracted from any part of the plant genus Cannabis L. and any compound, manufacture, salt, derivative, mixture, or preparation of such resin.

MARIJUANA
All parts of the plant genus Cannabis L., whether growing or not; the seeds thereof; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant or its seeds, except those containing resin extracted from such plant; but shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks, fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination.

PUBLIC BUILDINGS
Any Township- or Board of Education-owned or leased buildings, including but not limited to all schools, municipal buildings, library, senior center, health center, etc., in which the public is invited or the public is permitted.[1]

SMOKING
The burning of a cigar, cigarette, pipe or any other matter or substance which contains any form of tobacco, marijuana, or hashish. Said definition shall include the use of nicotine delivery systems, electronic cigarettes, or personal vaporizers using tobacco, marijuana, or hashish or their by-products.

TOBACCO PRODUCT
Any product made from the tobacco plant or containing tobacco leaf, for the purpose of smoking, chewing, inhaling or other personal use, including but not limited to cigarettes, cigars, pipe tobacco, chewing tobacco, snuff and dipping tobacco. Tobacco products shall also include electronic cigarettes, personal vaporizers using tobacco or tobacco by-products, or nicotine delivery systems.

TOWNSHIP PROPERTIES
All lands and grounds leased or owned by Jefferson Township, including but not limited to all recreation fields, parking areas and grounds adjacent to the buildings leased or owned by Jefferson Township.

A. 
Smoking in public buildings, on Township properties, on recreation properties and on Board of Education properties as herein defined within the Township of Jefferson is prohibited.
B. 
"No Smoking" signs or the international no smoking symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a diagonal red line through its cross-section) shall be posted at each public building entrance and within said building, as well as at conspicuous locations on Township properties, on recreation properties and Board of Education properties, in a number and in a manner determined by the administrator in charge of each such building or on such Township property, Board of Education property or recreation property to be sufficient to inform the public that there is no smoking allowed within the public buildings or on any such Township, Board of Education or recreation properties. The signs may contain a warning that smoking within the building or on any such property is subject to a fine. The failure to post any such sign shall not be a defense to a violation of this chapter.
C. 
This prohibition does not apply to persons on Township roads.

It shall be unlawful for any person under the age of 19 years to smoke a tobacco product in any public building or on any public grounds as defined herein or to possess any type of container containing a tobacco product in a public building or on public lands as herein defined.

In view of the indiscriminate sales of tobacco products to minors through tobacco vending machines, no vending machines located within the Township of Jefferson shall be permitted to sell or dispense tobacco products as herein defined unless said machine contains a functioning locking device to prevent the indiscriminate sales of tobacco products. Said locking device would only be unlocked at such time that the person who wants to purchase a tobacco product from a vending machine satisfies the owner or operator of said machine that he or she is over the age of 19 years, in which event any persons over 19 years of age would be able to purchase tobacco products from a vending machine.

It shall be unlawful within the Township of Jefferson to offer for sale or to sell tobacco products from a self-service display. All self-service tobacco displays now located within the Township of Jefferson made unlawful by the terms of this chapter shall be removed within 30 days from the effective date of this chapter.

The enforcement authorities of this chapter shall be the police officers of the Township of Jefferson, the Health Officer of the Township of Jefferson, and the Township Code Enforcement Officer, and their respective designees.
A. 
Any person who violates any provision of this chapter shall be subject to the following:
(1) 
A fine in the maximum amount of $125 for the first violation.
(2) 
A fine not to exceed the amount of $200 for the second violation.
(3) 
A fine not to exceed the amount of $300 for each additional violation thereof.
B. 
The Municipal Court shall have the right, upon the conviction for a first violation, to suspend such penalty upon the condition that the violator attend a program or programs relating to the harmful use of smoking and the use of tobacco products and that the violator produce proof of attending said program.
