On the second Monday in April of each year,
or as soon thereafter as may be practical, the President of the Village
shall, by and with the consent of Council, appoint the following officers:
One Marshal, who shall also be Pound Master; the Chief of the Fire
Department; a Village Surveyor; a Village Physician; one Street Commissioner;
and as many policemen and watchmen as said Council shall, by resolution
or ordinance, authorize; and the Council shall, at the same time herein
provided for the appointment of officers by the President, appoint
two competent freeholders of said Village, who shall, with the Assessor
thereof, constitute the Board of Review of the Assessments provided
by Chapter IX of the Charter.
Every appointment so made by the President shall
be presented to the Council for its consent, and unless the appointment
shall be ratified by a majority vote of the Trustees, it shall be
of no effect.
On the second Monday in April of each year,
or as soon thereafter as may be practical, the Village Council, by
a majority vote of the members thereof, shall appoint a Village Attorney,
who shall serve at the pleasure of the Council.
The Village Marshal shall have all the power
and duties prescribed by the Charter. In addition thereto, all the
powers and duties of Pound Master are hereby conferred upon him. He
shall give a bond in the penal sum of $500 for the faithful performance
of the duties of his office, including those of Pound Master, to be
approved by the Council.
It shall be the duty of the Village Attorney
to appear for and in behalf of said Village in all suits and legal
proceedings wherein said Village may be a party, and he shall act
as the attorney or solicitor for said Village therein, and he shall
be the legal advisor of the Village Council and officers in all matters
in which said Village may be interested, and he shall have authority
to commence and prosecute suits for and in the name of said Village.
The Treasurer shall give a bond in at least
the penal sum of $3,000 and in such greater sum as the Council may
at any time order by resolution, and with such sureties as may be
approved by the Council for the faithful performance of the duties
of his office.
The Chief of the Fire Department shall have
all the power and duties prescribed for him by the Charter.
The Street Commissioner shall have all the powers
and duties prescribed by the Charter, and in addition thereto such
powers and duties as shall be conferred upon and required of him from
time to time by ordinance.
The policemen and watchmen shall perform such
duties as may be required of them by law or by order of Village Council
or Marshal.
Vacancies in office shall be filled in the same
manner as the initial appointment.
Removal of any officer appointed hereunder shall
be had by a majority vote of the Village Council upon a finding that
such officer has been guilty of misfeasance, malfeasance or nonfeasance
in office.
