No person shall leave or place or cause to be
left or placed any stones, brick, boards, plank, timber, lumber or
other material for building in or upon any street, lane, alley or
public ground in said Village of New Haven without permission of the
Village Council.
The Village Council may permit any person to
place and keep building materials in any of the streets or alleys
of said Village, for a period not exceeding three months, but such
permission shall not authorize the obstruction of any part of the
sidewalk or gutters of said street or any crosswalk, nor more than
1/3 of the carriageway of the street opposite the lot or place where
such building is proposed to be erected, and such permit shall in
all cases be issued upon the express condition that such applicant
or applicants shall keep such material while it remains in any street
or alley carefully guarded, so that no damage to persons or property
shall be occasioned thereby. And to save the Village of New Haven
harmless from all loss or damage in consequence thereof, the Village
Council may, in its discretion, require any applicant or applicants
to enter into a bond to the Village of New Haven, with good and sufficient
sureties to be approved by the Council, conditioned as above specified,
that such applicant or applicants shall obey any direction which the
President or Street Commissioner may give in relation to proper guards
or lights about such material while in any street or alley.
Any person to whom such license may be granted
as aforesaid shall cause all such building materials and all rubbish
arising therefrom to be removed from the street at the expiration
of the time limit in such license.
No person shall move any building or frame of
building into or upon the public streets or grounds of said Village,
or cause the same to be done, or otherwise obstruct the free passage
of such street, without the permission of the Village Council, which
permission shall designate the route to be taken and the time to be
occupied in the removal of such building or structure. No person shall
leave any building while in the process of removal standing over any
cross street at any time, and if it shall be necessary for such building
to stand in any street or public place overnight, the person having
charge thereof shall place good and sufficient lights upon the same
as a warning to persons passing over such street of the situation
thereof, and such light or lights shall be kept burning during the
night.
No person shall suffer his or her or their horse,
horses, mule or mules, oxen team, carriage, wagon, cart, sleigh or
other vehicle to stand upon any of the sidewalks or crosswalks of
said Village, nor fasten any horse or other animal in any street in
such manner that the said horse or other animal, or the vehicle to
which the same is attached, shall obstruct the free passage of persons
on or over any part of such sidewalk or crosswalk, and no person shall
permit any horse, horses or mules to stand in any public street, lane,
alley or public place in said Village without being securely tied,
fastened or held.
A. No person shall place or cause to be placed or keep
or suffer to remain any logs, timber, lumber, box, cask, barrel or
other articles in any street, lane or alley or on any sidewalk of
said Village so as to incommode or obstruct the free use and passage
thereof, but this section shall not be construed to prohibit merchants
or others from placing goods and merchandise, household furniture
and other commodities on the sidewalk for the purpose of loading or
unloading, provided that the same be removed without unreasonable
delay.
B. No person shall place any goods, wares, merchandise
or other articles in front of any store, shop or other building further
than three feet on the sidewalk next to the building, and no owner
or occupant of any building shall cause or permit any firewood to
be placed or remain or be sawed, cut or split on any sidewalk or crosswalk.
No person shall draw or propel any bicycle or
tricycle, wagon, carriage, sleigh or other vehicle, or lead, drive
or ride any horse or horses, beast or beasts of burden, or any cattle,
sheep or swine over or upon any sidewalk within the Village, except
in passing across the same into or from any lot.
No person shall injure or tear up any pavement,
sidewalk or crosswalk, drain or sewer, or any part thereof, within
said Village, or dig any hole or drain in any street, or remove any
earth or stone therefrom without permission of the Street Commissioner
or the Village Council, or deposit, in any way, any wood, stone, earth
or other substance into any of the drains or sewers of said Village,
or cause the same to be done, nor shall any person drain any privy
vault or water closet into any of the drains or sewers of said Village
or cause the same to be done, or cause any obstruction or injury in
or to the same, or hinder or obstruct the making or repaving of any
sidewalk or crosswalk, drain or sewer being constructed or repaired
under any ordinance or resolution of the Village Council, or hinder
or obstruct the Street Commissioner or any person in his employ or
under his direction in constructing or repaving any street sidewalk
or crosswalk, drain or sewer, or other public improvement, directed
or authorized by the Village Council or required by any ordinance
of said Village or by any law of this state. It shall be the duty
of any person, contractor, officer of the Village or of the Village
Council thereof, who shall dig or tear up any pavement, sidewalk or
crosswalk, or dig any hole, ditch, drain or sewer in any street, alley
or other public place to well and sufficiently guard the same and,
as speedily as practicable, to repair and put the same in good order
and condition as before, and any person or persons excavating for
cellars or other purpose upon the borders of any street, sidewalk
or public place, or the contractor or owner or owners of property
for whose benefit such excavations may be made or for any purpose
whatever, shall erect and maintain a good and sufficient fence or
barrier around each excavation, hole or ditch, drain or sewer at all
times in such manner as to prevent accidents or injury to persons
or property, and also to place and keep on such fence or barrier suitable
and sufficient colored lights showing a red color during each night
that such excavation, hole, ditch, drain or sewer remains uncovered
or unfilled. Any person or officer of said Village or of the Village
Council or any contractor with said Village for the performance of
public work, violating any of the provisions of this section, shall
be liable to the punishment hereinafter provided.
No person shall construct any drain or sewer
from his cellar or lot to any common sewer of said Village without
permission of the Village Council, and every such drain or sewer shall
be constructed under the direction of the Village Council and in such
a manner that the foul air shall not escape from said sewer, and any
person who shall construct any drain or sewer contrary to the provisions
of this section shall be liable to the punishment hereinafter provided,
and the said Council may also direct that such drain or sewer may
be filled up or altered, in its discretion, and that the same be done
at the expense of the owner of such cellar or lot or of the person
who shall have caused the same to be constructed.
The Street Commissioner shall repair or cause
to be repaired all streets, alleys, roads, highways and public grounds
within said Village whenever so ordered to do by the Village Council.
It shall be his duty to report to the Council every violation of any
ordinance relating to the streets or nuisances in said Village that
shall come to his knowledge, He shall also, at the first regular meeting
of the Village Council in each month, report to the Council a true
account of the labor bestowed by him and the persons employed by him
in repairing the streets, sidewalks and crosswalks, alleys, drains,
sewers and public grounds of said Village, and the amounts of monies
expended by him in such repairs, the manner in which the same has
been expended, and to whom paid.
No person shall encroach upon or encumber any
highway, street, alley or public ground of said Village without permission
of the Village Council first had and obtained. In case any building,
fence, excavation or structure, which is now or may be hereafter erected,
made or placed in the Village of New Haven, shall extend into, upon
or over any part of/or portion of any highway, street, alley or public
ground of said Village, or shall in any way obstruct or impede the
full and free use and enjoyment by the public of such highway, street,
alley or public ground, the Street Commissioner shall serve a written
notice on the maker, owner or occupant thereof, if a resident of said
Village, and if not a resident of said Village, by posting such notice
in a conspicuous place on the premises connected with such encroachment,
which notice shall specify the nature, location and extent of such
encroachment and shall require such maker, owner or occupant to remove
or remedy the same within 30 days, and if such maker, owner or occupant
shall not within the time specified in such notice, remedy or remove
such encroachment or obstruction, he shall be liable to the punishment
hereinafter provided. In addition to the penalty herein provided,
the Village Council may direct the Street Commissioner to remove such
encroachment or obstruction at any time after the expiration of the
time specified in such notice at the expense of such maker, owner
or occupant, who shall be liable to pay the said expense to said Village
with damages and cost of suit.

Any person or persons who shall violate any of the provisions or requirements of this article, on conviction thereof, shall be punished as set forth in Chapter
59, Municipal Civil Infractions, of the Code of the Village of New Haven.
