In conformity with Section 2a of Act No. 88
of the Public Acts of 1978, as amended, MCLA § 257.942a,
the Village of New Haven shall provide for parking spaces specifically
designated for handicappers in each shopping center parking area within
its jurisdiction. These spaces shall be created in numbers which conform
with the requirements of section 2 of Act No. 1 of the Public Acts
of 1966, MCLA § 125.1352.
As used in this article, the following terms
shall have the meanings indicated in this section:
HANDICAPPER PARKING SPACE
A parking space 12 feet wide marked off in blue paint, which
parking space shall be identified by a sign approximately six feet
above grade inscribed with the international wheelchair symbol or
a reasonable facsimile thereof.
PARKING AREA
An area used by the public as a means of access to and egress
from and for the free parking of motor vehicles by patrons of a shopping
center, business, factory, hospital, institution or similar building
or location.
SHOPPING CENTER
A minimum area of three acres of land on which there is located
one or more stores or business establishments and where there is provided
a parking area.
If on the effective date of this section a shopping
center is in compliance with a local ordinance relating to the number
of parking spaces which the shopping center is required to provide,
the shopping center shall not be held in violation of that ordinance
if the designation of parking space required by this article reduces
the number of parking spaces below the minimum number required by
the local ordinance.
The Village of New Haven, upon request of either
the owner or the person in charge of the general operation and control
of any private parking area, shall:
A. Provide for the designation of handicapper parking
spaces in the parking area.
B. Provide for the towing away and/or impoundment, by
the Police Department, of a vehicle not properly identified as a handicapper
as provided in this article.
C. Designate traffic lanes; regulate traffic by means
of traffic control signals or signs to facilitate use of lot for handicappers.
Any person utilizing or who owns the vehicle
utilizing a parking space designated as a "handicapper" space in a
parking area without a handicapper license plate or other official
handicapper certification on the vehicle shall be responsible for
a violation of this article.
