This code shall be administered by the Building
Commissioner of the Town of Marblehead who shall at all times be under
the direct control of, and responsible to, the Select Board.

A. The Building Commissioner shall be qualified by education
and experience in both construction and town planning to perform properly
the duties of the office. The compensation of the Commissioner shall
be determined by the Select Board.
B. Should the Commissioner become interested in the doing
of work or the furnishing of materials for the construction, repair
or alteration of any building in the Town of Marblehead, or in the
making of any plans or specifications therefor, then the application
shall be referred to the Select Board who shall appoint a competent
person to act as Commissioner in the Commissioner's stead and may
fix the compensation to be paid said person.

A. The Commissioner shall keep a record of all business
of the Commissioner's department and shall submit to the Select Board
a yearly report of said business, and such other reports as they may
at any time require.
B. He shall receive applications and issue permits for
the erection and alteration of buildings, as hereinafter described
and shall keep detailed and sufficient records of such applications
and permits.
C. He shall, as often as practicable, inspect all building
work for which a permit may have been issued, and shall make a record
of all violations of this code, with the names of the owner, occupant,
architect and builder, and of any other matters pertinent thereto.
D. He shall require to be furnished and shall keep a
copy of the plans and specifications of every building used for public
purposes, and of such other buildings as may be hereinafter so required.

A. Any requirements necessary for the strength or stability
of any proposed structure, for the safety of the occupants thereof,
or for the protection of adjoining property, not specifically covered
by this code, shall be determined by the Commissioner, subject to
appeal.
B. If the Commissioner finds that the terms of a permit
are being violated, the Commissioner may, after notice mailed to whom
the permit was issued, order the whole or any part of the work, which
is being done under the permit, to be stopped, and such work shall
not be resumed until the terms of the permit have been complied with.
