A. There is hereby created a Board of Recreation Commissioners of the
Borough of Fanwood, to consist of the Mayor, ex officio, and seven
members, all of whom shall be citizens and residents of the Borough
of Fanwood.
B. The Board of Recreation Commissioners shall also consist of four
alternate members. Said alternates shall have the same qualifications
as the regular members of the Board and shall be designated at the
time of appointment as "Alternate No. 1," "Alternate No. 2," "Alternate
No. 3," and "Alternate No. 4."

The Board of Recreation Commissioners shall at all times be
subject to the general authority of the Mayor and Borough Council
but shall have the following powers, duties and authority:
A. Determine the recreation needs of the Borough of Fanwood.
B. Establish policies and standards therefor.
C. Provide facilities and a program to comply with the recreation needs
of the Borough.
D. Appoint the Executive Director and recommend his/her salary to the
Mayor and Borough Council for approval.

E. Appoint such other personnel as from time to time the Board of Recreation
Commissioners may deem proper and necessary and fix their salaries
within the Board of Recreation Commissioners' budget.
F. Promulgate, adopt and approve such rules and regulations as the Board
of Recreation Commissioners shall deem fitting and proper to carry
out its purposes and objectives.
G. Prepare and submit an annual report to the Mayor and Borough Council.

A. The members of the Board of Recreation Commissioners shall be appointed
by the Mayor, with the approval of the Borough Council, for terms
of five years. The term(s) of the current members of the Board of
Recreation Commissioners expire as follows: Thomas Smith (December
31, 1993); Carl Axt (December 31, 1994); Nancy Bantz (December 31,
1994); Edward Colangelo (December 31, 1995); George Speer (December
31, 1996); Patricia Hoynes (December 31, 1997); and vacant position
(December 31, 1998).
B. One member of the Borough Council shall serve as liaison to the Board
of Recreation Commissioners.
C. Alternate No. 1 shall be appointed for a term of five years with
the initial term ending December 31, 1997. Alternate No. 2 shall be
appointed for a term of five years with the initial term ending December
31, 1996. Alternate No. 3 shall be appointed for a term of five years
with the initial term ending December 31, 2005. Alternate No. 4 shall
be appointed for a term of five years with the initial term ending
December 31, 2004.

In the event of a vacancy caused by the death, inability or
resignation of any member, the Mayor, with the approval of the Borough
Council, shall appoint another person to fill the unexpired term of
such a vacancy.

The Mayor, with the approval of the Borough Council, shall each
year name one member of the Board of Recreation Commissioners as Chair,
to serve for one year.

The powers and duties of the Chair shall be as follows:
A. To preside over all meetings of the Board.
B. To appoint a Vice-Chair and Recording Secretary and an Acting Chair
in the event of the nonavailability of the Chair or Vice Chair.
C. To appoint such committees as may be authorized by the Board of Recreation
Commissioners to carry out the objects and purposes of the Board of
Recreation Commissioners.
D. To authorize the discharge or release for cause of any employee upon
request and certification of the Executive Director.
E. To certify, together with the Executive Director, to the Borough
Treasurer all expenditures of the Board of Recreation Commissioners.
The Board of Recreation Commissioners shall appoint a staff
to consist of an Executive Director and such other personnel as may
from time to time be deemed proper and necessary by the Board of Recreation
Commissioners for the furtherance of its objects and purposes.
The Executive Director shall have the following powers, authority
and duties:
A. Plan, organize, direct and evaluate the program of activities authorized
and directed by the Board of Recreation Commissioners.
B. Supervise the maintenance and use of the recreational facilities
operating under the control of the Board of Recreation Commissioners.
C. Employ, with the approval of the Board of Recreation Commissioners,
and organize, train and supervise all departmental personnel and assign
their respective duties to them.
D. Keep careful and complete records of departmental activities and
services and of the personnel of the Board of Recreation Commissioners
and keep a complete inventory and record of all property of the Board
of Recreation Commissioners.
E. Attend all meetings of the Board of Recreation Commissioners except
in those cases where the Board of Recreation Commissioners holds a
closed session and advises the Executive Director not to be present.
F. Prepare and present an annual report to the Board of Recreation Commissioners
at the close of each year.
G. Certify, together with the Chair, to the Borough Treasurer all expenditures
of the Board.

Regular meetings of the Board shall be held at the call of the
Chair or, in his/her absence or disability, at the call of the Vice
Chair; provided, however, that a meeting shall be called upon the
written request of five members of the Board. At least 48 hours'
notice of any such meeting, in accordance with the Open Public Meetings
Act, shall be given to all members. At all meetings, a quorum shall
consist of a majority of the members of the Board, exclusive of the
Mayor.

Any interest earned on moneys in the Recreation Commission's
checking account established pursuant to New Jersey law and regulations
promulgated by the New Jersey Division of Local Government Services
shall not be treated as current revenue but shall become part of the
principal within the Recreation Commission checking account and may
be used for the same purpose or purposes by the Recreation Commission
as such principal funds are used.
