It shall be unlawful for any person to ride,
propel, push or otherwise use a skateboard or use in-line skates (a.k.a.
"roller blades") and/or roller skates on any of the public ways, streets,
alleys, sidewalks and/or public parking lots within the corporate
boundaries of Oakland, unless such area has been specifically designated
for said use by the Mayor and Town Council of Oakland, by its resolution.
Any person violating the provisions of §
229-1 hereof shall be deemed guilty of a municipal infraction subject to the maximum fine established pursuant to Chapter
40, Municipal Infractions.
In the event that any law enforcement officer
empowered to act as such within the Town of Oakland observes any minor
child operating a skateboard, in-line skates (a.k.a. "roller blades")
and/or roller skates in violation of the provisions of this chapter,
the law enforcement officer may confiscate the skateboard, in-line
skates (a.k.a. "roller blades") and/or roller skates operated and/or
used by said minor and, unless the officer is aware that it is a second
or subsequent offense, return the skateboard, in-line skates (a.k.a.
"roller blades") and/or roller skates only to the said minor child's
parent or guardian. Any law enforcement officer authorized to act
as such within the Town of Oakland who observes an adult operating
a skateboard, in-line skates (a.k.a. "roller blades") and/or roller
skates in violations of the provisions of this chapter shall confiscate
the skateboard, in-line skates (a.k.a. "roller blades") and/or roller
skates. In the event that the officer is aware that there has been
a prior offense by a minor child, the officer is authorized to confiscate
the skateboard, in-line skates (a.k.a. "roller blades") and/or roller
skates. A law enforcement officer shall be authorized to confiscate
a skateboard, in-line skates (a.k.a. "roller blades") and/or roller
skates whether or not he/she issues a charge for violation of this
chapter.
