It shall be unlawful for any owner, occupant
or person in control of any lot or land within the Town to allow or
maintain on any such lot or land any growth of weeds or other vegetation
to a height in excess of eight inches. Every owner, occupant or person
in control of any lot or land within the City shall cause such lot
or land to be kept free from rubbish, debris, ragweed, wild mustard,
wild lettuce, wild parsley, common thistle, milkweed, poison ivy and
all other noxious weeds by destroying such noxious weeds by spraying
with a chemical compound, by cutting and removal, or by any other
lawful method. It shall likewise be unlawful for any property owner
to permit grass, weeds or any vegetable matter, other than shade trees,
to grow or remain growing upon the sidewalks, curbs, or gutters abutting
his property.
A.
In the event the owner, occupant or person in control
of any lot or land within the City shall refuse, fail or neglect to
cut and remove such weeds or growth, the same may be done by the Mayor
and Town Council of Oakland, Maryland, or their designated agent may
cause removal of the same. The cost of such removal shall be charged
to the owner of such property; provided, however, that a minimum charge
of $50 per lot or parcel for such removal is hereby established.[1]
B.
Should said charges remain unpaid after 90 days, the
same shall constitute a lien on said property and shall be filed in
accordance with the laws of the State of Maryland.
Any person violating any of the provisions of this chapter shall, in addition to the other remedies provided for herein, be deemed guilty of a municipal infraction subject to the maximum fine established pursuant to Chapter 40, Municipal Infractions. Each day a violation is allowed to continue shall constitute a separate offense.
