As used in this chapter, the following terms shall have the
meanings indicated:
MOVEABLE PROPERTY
Any piece of moveable property, regardless of ownership by
the offender, which completely or substantially obstructs, impedes,
or otherwise prevents citizens from safely accessing a public walkway,
as defined in this section.
PUBLIC WALKWAY
Any public sidewalk, street, or other path upon which pedestrians
have the right-of-way.
TEMPORARY STRUCTURE
Any three-dimensional construct, whether permanent or temporary,
which obstructs, impedes, or otherwise prevents citizens from safely
accessing a public walkway as defined in this section.
WAIVER
Under certain extenuating circumstances, the Town may grant
a temporary exemption from the rules of this chapter.
It shall be unlawful for any person or such person's agents
or employees to leave, or to suffer to be left, any boxes, movable
property, or temporary structures whether owned or not owned by the
offending party, or to erect or cause to be erected any shed, building,
or other obstruction on a public walkway.
It shall be unlawful for any person to obstruct a public walkway
with their body after sunset by lying prone in the public walkway.
Any person found to be violating the provisions of this chapter without a waiver shall be deemed a municipal infraction and, upon conviction, be punishable as provide in Chapter
40, Municipal Infractions.
