The use of municipal parking lots has been abused
in the past by vehicles being parked there for days at a time and
by people sleeping through the night in vehicles parking thereon in
violation of Borough ordinances. It appears to be in the best interest
of the Borough that motor vehicles should not be permitted to park
on unmetered municipal parking lots between the hours of 2:30 a.m.
and 5:30 a.m., except at the designated area in the Borough Marina
parking lot.

The parking of motor vehicles on unmetered municipal
parking lots and other unmetered municipally operated property between
the hours 2:30 a.m. and 5:30 a.m. is prohibited, except at the designated
area in the Borough Marina parking lot. Some of the municipal parking
lots are metered and some are unmetered, and when an unmetered parking
lot becomes metered, this prohibition shall not be applicable thereto.

The parking of any and all vehicles of any type
and description, except charter buses, on municipally owned parking
lots shall be controlled by the markings painted on the surface of
the lot, which provide a space for each vehicle, and/or by an appropriate
sign wherever practicable. Any vehicle of any type and description,
except charter buses, which is parked in a manner other than that
indicated by signs and/or surface markings shall be considered to
be in violation of this chapter. Charter buses utilizing public roadways
or parking areas for loading or unloading shall do so in a manner
not likely to cause a substantial risk of injury to any person or
damage to any property. Charter buses shall not park or idle in any
public right-of-way or parking lot except when actually loading or
unloading passengers, except that such buses may park in designated
parking spaces at the public parking area in the vicinity of 80th
Street and the public marina.

The parking of recreational vehicles of any type and description shall be prohibited on municipally owned parking lots except for areas so designated by surface markings or signs which provide for the parking of this type of vehicle and as restricted by §
391-7. For the purposes of this chapter, any vehicle with a length of more than 20 feet is designated as a recreational vehicle.
Sections
386-1 and
386-4 of this chapter shall not apply to police vehicles, fire and rescue vehicles, municipal vehicles and the private vehicles of those personnel when they are performing municipal duties in connection with police, fire, rescue and other municipal functions.

A. Parking by permit upon the following five parking lots in the Borough is hereby authorized: the two parking lots east of Sunset Drive on the north side of 96th Street (Lots 238 through 245 and Lots 249 through 254 in Block 95.4), the parking lot west of Second Avenue on the south side of 97th Street (Lots 80, 82, 84, 86, 88, 90 and 92.1 in Block 97.3), the parking lot adjacent to the Stone Harbor Firehouse, described in §
386-2 as "Southwest corner of 96th Street and Seng Place," Second Avenue on the west side between 93rd and 94th Street (Block 93.03, Lots 71 through 78). The permit will authorize the permit holder to which the permit is issued to park on said parking lots, without putting any money into the parking meter during the time periods for which the parking permit is issued.

B. The cost
of a parking permit shall be as established from time to time by resolution
of the governing body of the Borough of Stone Harbor, and each permit
shall be transferrable.
Short-term parking, for periods not to exceed two hours, shall be permitted upon all Municipal parking lots with the exception of those set forth in §
386-9. Parking for more than two hours in succession is specifically prohibited in such short-term parking lots.

Long-term parking shall be permitted upon the two lots on the north side of 96th Street west of Third Avenue and on the one lot on the south side of 97th Street between Second Avenue and Third Avenue. The parking on these lots shall be limited to four successive hours. Long-term parking shall also be permitted in the lots at 95th Street and the Beach and 96th Street and the Beach as provided in Chapter
391, Parking Meters.

No motor vehicle with an unloaded gross vehicle
weight of more than 6,000 pounds, or any vehicle with seating capacity
of more than nine persons, shall be parked upon any public parking
lot at any time unless said lot is specifically designated to allow
the parking of such vehicles. Briefly standing to load or unload shall
not be considered parking for purposes of this section.
Anyone convicted of a violation of the provisions
of this chapter, except for sections carrying their own specific penalty,
shall, upon conviction thereof, be subject to a fine of between $18
and $100 inclusive. Each day the violation continues shall constitute
a separate offense.
