As used in this article, the following terms shall have the meanings indicated:
SEASONAL SALE
Includes but is not limited to the sale of Christmas trees or parts thereof, wreaths, holly, pumpkins and other gourds, flowers and other related goods, wares and products, whether real or artificial.
Seasonal sales shall be regulated by special permit so as to protect the environment and to prevent the dangerous misuse of such articles in order to better protect the health, safety and welfare of the residents of the Village of North Syracuse.
Application for a special permit shall be as follows:
A. 
The applicant shall fill out a form provided by the Village, which shall be kept on file by the Village Clerk. Said application shall be approved by the Codes Enforcement Officer.
B. 
The applicant must state the inauguration and cessation of contemplated sales; the duration of such permit shall not exceed 60 continuous days.
C. 
The applicant must state the proposed site of the sale, with a letter from the owner of said site wherein the owner shall give approval for the applicant to use the site.
D. 
The refundable fee in accordance with the fee schedule established by the Board of Trustees for a seasonal sale permit shall be paid after approval by the Codes Enforcement Officer.[1]

The applicant must show bona fide provisions for the removal of all unsold goods, wares, merchandise, products or parts thereof, real or artificial, within seven days after the cessation date as stated on the application. The Codes Enforcement Officer shall inspect the site of sale, and if he verifies that said area has been cleaned, the fee shall be returned to applicant.

Violation of any provisions of this article shall be punishable by forfeiture of the required fee and by a maximum fine of $250 or a term of imprisonment not to exceed 15 days, or both. Each day any such violation shall continue shall constitute a separate violation.
