No building permit or certificate of occupancy shall be issued for any use or structure authorized by this chapter nor shall any structure or use be enlarged, modified, altered or changed, except one- and two-family residences and those requiring special permits in this chapter, until site plan approval has been granted by the Planning Commission. As to those uses or structures requiring special permits in this chapter, site plan approval shall be required only when made a condition of approval of a special permit by the Board of Trustees.
A. 
Application for site plan approval shall be made on the forms provided therefor and available from the Codes Enforcement Officer's office. Such application shall be signed and contain a verification made by the owner, contract purchaser, lessee or other person entitled to seek such approval. The application shall be accompanied by 15 copies of a site plan containing the information hereinafter set forth, a certified check or money order in such amount as may from time to time be determined by resolution of the Village Board of Trustees to cover the cost of processing said application and such other documents and exhibits as may be requested by this chapter and any laws, rules or regulations of the Village of North Syracuse, County of Onondaga, State of New York or United States or any of their several departments, agencies or bureaus.
B. 
Upon receipt of a completed application and all supporting documentation, the Codes Enforcement Officer shall cause a copy of such application and supporting documents to be sent to each member of the Planning Commission, Syracuse-Onondaga County Planning Agency and any other agency, department or person who is entitled under law to receive such application.
A. 
Not later than 10 days prior to the date of the meeting of the Planning Commission at which such application shall be heard, the Codes Enforcement Officer shall cause a notice of the pendency of such application to be sent to the record owner of all adjacent parcels of land.
B. 
The Planning Commission may require that an advisory public hearing be held on any site plan application when, in the opinion of the Planning Commission, formalized public input would be necessary or advisable. Notice of such a public hearing shall be provided in the official Village newspaper at least five days before the hearing, and on no account shall the failure to provide notice of such a hearing give rise to any rights of claims by any person.
C. 
Within 62 days from the date of the close of the hearing before the Planning Commission at which the application is considered, or after the day the application is received if no hearing has been held, the Planning Commission shall adopt a resolution approving, approving with modifications or disapproving such site plan. The facts supporting the Planning Commission's determination and its reasons for approval or disapproval shall be set forth in its resolution, and a copy of the decision shall be mailed to the applicant.[1]

The applicant shall submit a site plan and supporting data which has been prepared by an architect, landscape architect, engineer, land surveyor or planner and shall include the following information, accompanied by a written text describing the intent of the project in question:
A. 
A survey of the property, showing existing features of the property, including contours, buildings, structures, major trees, streets, utility easements, rights-of-way, land use and sign locations.
B. 
A site plan showing proposed building locations, traffic circulation, parking and loading spaces and pedestrian walks.
C. 
Landscaping plans, including site grading and landscape design and plant materials, including a summary of transportation movement and circulation patterns of major highways to the site in question.
D. 
Preliminary architectural drawings for structures delineated to be constructed, including floor plans, exterior elevations, sections and dimensions.
E. 
Preliminary engineering plans, including street improvements, public utility systems and hydrant locations.
F. 
Engineering feasibility studies of any anticipated problems which might arise due to the proposed development, upon request of the Planning Commission.
G. 
Construction sequence and time schedules for completion of each phase for buildings, parking spaces and landscaped areas.
H. 
A description of the proposed uses, including hours of operation, number of employees, expected volume of business and type and volume of traffic expected to be generated.
I. 
Building construction information, including the type of construction, fire areas and other information as requested by the Fire Marshal or Codes Enforcement Officer.
J. 
Stormwater pollution prevention plan. A stormwater pollution prevention plan consistent with the requirements of Chapter 201 of the Code of the Village of North Syracuse.

A. 
The Planning Commission shall review the site plan and supporting documents and shall render its decision based upon the following criteria, among others, and its resolution shall specify the findings of the Commission, if any, for each of these criteria:
(1) 
Conformance with the provisions of this chapter.
(2) 
Harmonious relationship between proposed uses and existing adjacent uses.
(3) 
Maximum safety of vehicular circulation between the site and the street network.
(4) 
Maximum adequacy of interior site circulation, parking and loading facilities, with particular attention to vehicular and pedestrian safety.
(5) 
Adequacy of landscaping and setbacks in regard to achieving maximum compatibility with and protection of adjacent residential districts.
(6) 
Appropriateness of drainage facilities and ability of off-site drainage or other facilities to handle the needs of the proposed sites.
(7) 
Stormwater pollution prevention plan. A stormwater pollution prevention plan consistent with the requirements of Chapter 201 of the Code of the Village of North Syracuse shall be required for site plan approval. The stormwater pollution prevention plan shall meet the performance and design criteria and standards of Chapter 201 and other applicable provisions of the Code of the Village of North Syracuse.

B. 
The Planning Commission may require changes or additions in relation to yards, driveways, driveway entrances and exits and landscaping and in the location and height of buildings and enclosures to ensure safety, to minimize traffic difficulties and to safeguard adjacent properties.
Should the Planning Commission impose any conditions upon the approval of any such site plan, no building permit shall be issued purporting to authorize construction at variance with any such conditions, and no certificate of occupancy shall be issued unless and until such conditions have been fully met or performed. All improvements to the site shall be completed in strict conformance with the site plan as approved.
Any modification or change to an approved site shall require a new application to the Planning Commission for further site plan approval, except that the Codes Enforcement Officer is hereby delegated the authority to approve a modification to a previously approved site plan when such modification meets the following criteria:
A. 
The modification is in full compliance with the regulations set forth in this chapter.
B. 
The modification would not effect adversely any adjacent property.
Building permits shall be issued only in accordance with an approved site plan which shall be transmitted by the Planning Commission to the Codes Enforcement Officer.
An owner wishing to make changes in an approved site plan shall submit a revised site plan to the Planning Commission for review and approval before making application for a building permit.
