All local laws and parts of local laws, all local ordinances, local codes and regulations which are inconsistent with or in conflict with or are repugnant to any provisions of this Part 1 shall be deemed not to apply, provided that nothing herein contained shall be construed to prevent the adoption and enforcement of a law, ordinance, code or regulation which is more restrictive or establishes a higher standard than those provided in this Part 1.
A. 
Violation. A person shall be found in violation of this Part 1 when failing to adhere to any of the regulations or provisions of this Part 1.
B. 
Notification. The Sewer District shall notify the person that a violation has been determined by the Sewer District. Notification shall be in writing and shall explain details of the Sewer District's judgment of the violation.
C. 
Compliance. Within 30 days after notification of violation, the responsible person shall correct the violation, pay appropriate fines and notify the Sewer District in writing that the violation has been remedied, with a detailed description of actions taken.
D. 
Penalties. Any person violating any provision of this Part 1 is subject to a fine of up to the sum of $5,000 for violation of any provision of this Part 1. Any industrial user, special user or wastewater hauler violating any provision of this Part 1 is subject to a fine of up to the sum of $5,000. Each day a provision or regulation is violated is considered a separate violation. The district is further authorized to apply to the Supreme Court of the State of New York for injunctive relief where deemed necessary, in addition to the foregoing fines.
This Part 1 shall be effective on filing with the Secretary of the State and Department of Audit and Control.
