This Article shall be known as the "Discharge of Waste and Refuse Control
Law of the Village of Head-of-the-Harbor."

Stony Brook Harbor is the location of important recreational resources.
It also contains extensive fish and wildlife habitats of local and statewide
significance. It has supported for centuries a small but ongoing and locally
valued commerce in shellfishing. Its condition as a clean body of water is
indispensable to all such activities and to its continued viability as a habitat.
The Village of Head-of-the-Harbor, jointly with the Village of Nissequogue,
has entered into a Local Waterfront Revitalization Program under the New York
State Coastal Management Program, which includes a commitment to protect and
conserve the natural resources of the harbor. The discharge of wastes into
harbor waters from vessels or from the shore or the disposal into the waters
of any kind of refuse is inimical to the well-being of the harbor and its
continued existence as a valuable resource. It is equally a threat to public
health and safety as such discharges may contaminate waters containing shellfish
beds or used by swimmers.
The terms used in this Article are defined as follows:
REFUSE
Disposable materials not included above, such as vegetable matter,
garbage, wood and lumber and the like.
WASTE
Includes any disposable materials, including sanitary wastes, plastics,
paper, metals, chemicals, petroleum products and the like.
All regulations apply within the boundaries of the Village of Head-of-the-Harbor.

Any discharge or dumping of any waste or refuse into the waters of Stony
Brook Harbor from any location within the Village of Head-of-the-Harbor is
prohibited.
Penalties for violation of the above regulation shall be:
B. For a first violation of §
136-11B, a written warning by the police of Head-of-the-Harbor on patrol in the harbor area; for a second offense within the same calendar year, a fine of $250.
