Traffic and road use have increased in the Village
to a point where state laws are no longer adequate to meet the particular
needs of the Village. Accordingly, this chapter has been enacted to
adapt the law to specific needs of the community.

A. No one may drive a motor vehicle at a speed that is
not reasonable and prudent under the circumstances. The maximum speed
limit at which vehicles may proceed along any roadways within the
Village is hereby established at 25 miles per hour except when circumstances
require a lower speed or as otherwise provided for certain specifically
identified roadways. On roads that pass a school, the speed limit
within 300 feet of a school property line is 15 miles per hour from
8:00 a.m. to 5:00 p.m. on school days.
B. Speed limits other than 25 miles per hour are established
as indicated upon the following streets or parts of streets:

C. Circumstances which require a reduced speed include
but are not limited to crossing an intersection, approaching and driving
on a curve, approaching the crest of a hill, driving on a narrow or
winding road, the presence of a pedestrian or bicyclist, adverse weather
conditions and a road repair or construction activity.
A. The driver
of a motor vehicle that approaches a stop sign shall stop the vehicle
at a stop line, but if there is no stop line then at a point near
the intersecting roadway where the driver can see traffic on that
roadway, without allowing the vehicle to enter the intersection. The
driver of a motor vehicle that approaches a yield sign, if required
to stop in the interest of safety, shall stop the vehicle at a stop
line, but if there is no stop line then at a point near the intersecting
roadway where the driver can see traffic on that roadway, without
allowing the vehicle to enter the intersection. After stopping, the
driver shall proceed in accordance with state rules of the road for
rights-of-way.
B. For the
purpose of maintaining an accurate record of all regulations adopted
under the provisions of this section, there is hereby established
a system of schedules in which shall be entered all regulations after
adoption. Such schedules shall be deemed a part of this section.

C. Notwithstanding
any official traffic control signal indication to proceed and excepting
the order of a police officer otherwise, a driver of a vehicle shall
not enter an intersection unless there is sufficient space on the
other side of the intersection to accommodate completely the vehicle
driven without obstructing in any manner the through passage of vehicles
from either side. In no event shall a driver enter an intersection
described in Schedule D below marked by a "Do Not Block Intersection"
sign, except while observing the restrictions of this subsection.

The driver of a motor vehicle on a road with
marked lanes shall drive the vehicle in one lane and not leave that
lane except when a lane change is clearly safe. Where lanes are divided
by double lines, no driver may cross those lines except in an emergency.
No driver of a motor vehicle may allow the vehicle
to follow another vehicle more closely than is reasonable and prudent,
taking into account the vehicle's speed, traffic and the condition
of the road.
No one may place, dump or leave on a road, the
right-of-way of a road or on adjacent property refuse, trash, garbage,
rubbish, litter or offensive matter. Salting, sanding or otherwise
providing traction on snow or ice is not prohibited.
No motor vehicle may be parked on any road,
right-of-way of a road or property at the border of a road except
at locations which are marked by signs as parking areas during hours
when parking is permitted in accordance with the signs.
Persons operating motor vehicles and using Village
roads shall comply with lawful orders of a police officer, flagman
or other person authorized to regulate traffic, and they shall comply
with traffic control signs or devices and markings except when otherwise
directed by a police officer or other person authorized to direct
traffic.
A traffic control sign, device or marking shall
be presumed to be placed by lawful authority in accordance with the
requirements of law unless the contrary is established by competent
evidence.

Except for emergency vehicles and vehicles operated
by a government body in performance of its duties, no motor vehicle
of any kind shall be operated or parked on a steep slope, bluff beach,
nature conservancy or protected area, Village park (except for the
Village Hall), marsh or wetland. Operation and parking of vehicles
on public or private landings for boat launchings shall be a permissible
activity hereunder and not be prohibited under this chapter.

Automobiles, or any other vehicles which would
be required to be licensed if driven or operated on any of the highways
of the Village, shall be so licensed, and bear a current and valid
registration and registration number plate unless such vehicle is
a farm vehicle used exclusively for farming purposes, or unless such
vehicle is driven or operated solely on private property and is housed
in a garage or other suitable accessory structure when such vehicle
is not being driven or operated.

A. The outdoor display, storage, or parking of automobiles
or any other vehicles for the purposes of selling such vehicles upon
privately owned properties within the Village of Head-of-the Harbor
or on private or public roads within the Village is a source of annoyance
to members of the public and to owners and occupants of adjacent properties
which depreciates the value of neighboring properties. The outdoor
display, storage, or parking of such vehicles for sale is hereby deemed
to be unsightly and constitutes an unattractive nuisance. The preservation
of peace and good order and the protection of public health and property
compels legislation upon this subject. It is, therefore, declared
that the purpose of this section is the effective limitation of such
obnoxious practices.
B. It is hereby declared to be unlawful to display, store,
or park for the purposes of sale more than one such automobile or
other vehicle outdoors upon any privately owned property or on any
private or public roads within the Village.
C. Within the Village, any automobile or other vehicle
displayed, stored or parked for the purpose of sale of such vehicle
must belong to the owner or occupant of a privately owned property
within the Village.

A. The outside storage of any unlicensed, unregistered,
inoperative or discarded automobiles or any other vehicles upon privately
owned properties within the Village or in the streets adjacent to
said properties is a source of annoyance to members of the public
and to owners and occupants of adjacent properties. In addition, the
storage of any vehicles in excess of 72 hours, which vehicles are
raised on jacks, blocks or any other device, both on privately owned
properties within the Village or in the streets adjacent to such properties,
is also a source of annoyance to the public and to the owners and
occupants of adjacent properties.
B. The outdoor storage of such automobiles or other vehicles
described above on private land is hereby deemed unsightly and constitutes
an attractive nuisance to children and a peril to their safety. Further,
it depreciates the value of neighboring properties. The preservation
of peace and order and the protection of public health and property
compels legislation upon the subject. It is, therefore, declared that
the purpose of this section is the effective termination of such obnoxious
practices, setting forth the following rules and regulations:
(1) No property shall be used for the outside storage
of unlicensed, unregistered, inoperable or discarded automobiles or
other vehicles in any residential district within the Village, nor
shall any said vehicles be stored in any public streets adjacent to
said residential property.
(2) No such automobiles or other vehicle may be stored
or shall remain on any residential property or in the public or private
street adjacent to said property for more than 72 hours when raised
on jacks, blocks or any other device unless permission shall have
been received by the owner or occupant of the premises from the Building
Inspector, and any such vehicle is owned by the owner or occupant
of the premises.
(3) No automobile or other vehicle may be repaired or
dismantled on any residential property or private or public street
adjacent thereto, within the Village, unless said vehicle is owned
by the owner or occupant of the premises on which said vehicle is
being repaired or dismantled.
The roads covered by this chapter include all
streets within the Village, public and private, except North Country
Road.
A. A person convicted of violating this chapter may be
fined up to $175 or imprisoned up to 30 days, or both; for a second
violation of the same section of this chapter within 18 months of
the first, the fine may be up to $300 or 90 days in jail, or both;
for a third violation of the same section of this chapter within 18
months of the first, the fine may be up to $500 or 180 days in jail,
or both.
B. It is unlawful and it is a traffic infraction for
any person to do any act forbidden or to fail to do any act required
in this chapter.
