The Board of Trustees of the Village of Maybrook
and the Mayor are authorized to make a policy by resolution to govern
the implementation of this Part 1.
All newly hired police officers of the Village
of Maybrook who have been appointed by the Board of Trustees to a
full-time position with the Police Department of the Village of Maybrook
shall be obligated to pay for the entire cost of their basic police
training that is required by New York General Municipal Law § 209-q,
except that the Village of Maybrook Board of Trustees may pay the
cost of such training for each newly hired police officer who commits
to serve the Village Police Department as a sworn officer for three
years after successfully completing the prescribed training program.
Such commitment shall be in written form as prescribed by the Board
of Trustees, and shall provide that in the event a police officer
who has executed a commitment to serve three years as prescribed above
breaches his or her commitment, the Village shall be entitled to be
reimbursed for the costs incurred by the Village for the police officer's
basic training, after due demand for payment by the Village.
All newly hired police officers of the Village
of Maybrook who have been appointed by the Board of Trustees to a
full-time position with the Police Department of the Village of Maybrook
shall be responsible for the cost of uniforms and body armor, except
that the Village of Maybrook will pay the cost of uniforms and body
armor for officers who make a written commitment to serve the Village
of Maybrook as a sworn police officer for the requisite three-year
period after receiving training certification as prescribed above,
and upon a breach of that commitment by a police officer, the Village
shall be entitled to reimbursement by such police officer of such
costs after due demand for payment.
Where a police officer is obligated to reimburse
the Village for costs of attendance at the police training academy
and/or for uniforms or equipment as provided above by reason of a
breach thereof, the Village shall inform the officer of the amount
due, and may submit the dispute to an arbitrator for final and binding
disposition. The Board of Trustees is authorized to waive claims for
reasons of equity or where just cause is shown.
Where a police officer employed by the Village
of Maybrook in a full-time capacity has breached the commitment to
serve for three years as provided herein, the Village of Maybrook
may, in addition to other remedies provided herein, be reimbursed
by such police officer for compensation required to be paid by the
Village to another police officer for his or her attendance at the
basic police training academy required by General Municipal Law § 209-q,
incurred due to the failure of the resigning police officer to satisfy
his or her three-year commitment, measured as liquidated damages.
Such policy may be established by resolution of the Board of Trustees.
Full-time police officers shall have the same
holiday schedule that applies to other employees of the Village, except
that the Board of Trustees shall also specify what additional compensation
is due to full-time police officers for hours worked on holidays.
Full-time police officers may be entitled to
retirement benefits as set by Board of Trustees resolution from time
to time.
Full-time police officers may be entitled to
health insurance benefits as set by Board of Trustees resolution from
time to time.
The Board of Trustees of the Village of Maybrook
shall provide by resolution for the base compensation to be paid to
newly hired full-time police officers and such periodic steps in compensation
as such police officers shall be entitled to receive during the initial
two-year commitment and thereafter.
