The Town of Stony Point recognizes that the consumption of alcoholic
beverages by persons in public places tends to disturb the peace and quiet
enjoyment of the residents of the Town of Stony Point.
As used in this chapter, the following terms shall have the meanings
indicated:
ALCOHOLIC BEVERAGE
Any liquid intended for human consumption containing more than 1/2
of 1% by volume of alcohol.
PUBLIC PLACE
Any highway, street, road, shopping area, sidewalk and seawall located
within the Town of Stony Point and in any motor vehicle located thereat; provided,
however, that this definition shall not include any picnic area or campground
duly designated by a governmental authority where consumption or possession
of alcoholic beverages is permitted by such governmental authority; and provided,
however, that drinking in motor vehicles on public streets shall be regulated
by § 1227 of the Vehicle and Traffic Law.

It shall be unlawful for any person to consume, cause to be consumed
or possess in an open container any alcoholic beverage in any public place
within the Town of Stony Point.
Nothing contained herein shall be construed to prohibit any citizen
of the Town of Stony Point from consuming alcoholic beverages within and on
private property which he may own or have the right to possession under a
lease or otherwise.

Any person who is proved to have violated this chapter shall be guilty
of a violation and shall be subject to a fine not to exceed $250 or not more
than 15 days' imprisonment, or both.

The presence of an open container containing an alcoholic beverage within
a motor vehicle shall be presumptive evidence that said container is in the
possession of all persons occupying said vehicle.
