The parent or legal guardian, other than the state or a local social services department, having custody of an infant over 10 and less than 18 years of age shall, if such infant willfully, maliciously or unlawfully damages or destroys real or personal property owned or maintained by another, be guilty of a violation.
Liability under this chapter shall be strict, without regard to the mental state or culpability of said parent, legal guardian or custodian.
A. 
Any person found guilty under the provision of this chapter shall be fined an amount equal to the fair value of said damage or destruction but in no case more than $500.
B. 
For purposes of this section, "fair value of said damage or destruction" shall mean the lesser of:
(1) 
The replacement cost of such damaged or destroyed real or personal property; or
(2) 
The repair cost of such damaged or destroyed real or personal property.
