In this chapter, when not inconsistent with the context:

Words in the present tense include the future tense.

The singular includes the plural, and the plural includes the singular.

The male gender includes the female gender.

The verb "shall" is mandatory.

All words used herein shall have their customary and ordinary meaning except when specifically defined in this chapter or when not defined in this chapter, then as defined in Chapter 180, Zoning.
For the purpose of this chapter, certain words and terms used herein are defined as follows:
ACCESS ROAD
A right-of-way, not publicly dedicated, which provides access to one or more building sites. The maintenance shall be the responsibility of the owner.
ARCHITECT
Any person registered as an architect by the New York State Department of Education.
ARTERIAL ROAD
Roads designed to provide a high-volume network for travel between major points. Within the Town of Walworth, roads classified as arterial roads include Route 350, Route 441/Walworth-Marion Road, Gananda Parkway, Atlantic Avenue, Canandaigua Road, Plank Road, West Walworth Road, Lincoln Road, Walworth-Ontario Road and Walworth-Palmyra Road.

ATTORNEY FOR THE TOWN
The official attorney for the Town or any attorney authorized to represent the Town.
BOARD
The Planning Board of the Town of Walworth.[1]
CONCEPT APPLICATION
The submittal prior to a concept plan conference, if requested by the subdivider, presenting the, concept of the proposed project.

CONCEPT PLAT PLAN CONFERENCE
An informal meeting between the Board and subdivider to reach general agreement as to form of the proposed layout of the subdivision prior to engaging professional engineering services, except for the services which may be required in § 151-5B(2) of the Town of Walworth Municipal Code. If, however, a majority of the members of the Board indicate that they are favorably inclined toward the concept of the project proposed, the subdivider shall take this as an indication that the applicant can apply for preliminary subdivision approval, but in no event shall the subdivider take the Board's favorable indication that either preliminary or final approval will ultimately be given.

CONDITIONAL APPROVAL OF A FINAL PLAT
The approval of such plat, subject to the stipulations set forth in the resolution. With such approval, a final plat is not qualified for recording in the office of the Wayne County Clerk prior to the signing of the plat by the Chairman of the Board or other duly authorized member of the Board, certifying the completion of the requirements as may be stated in the resolution.
COST ESTIMATE
The estimated cost of construction of improvements to be dedicated to the Town as prepared by the subdivider's or site plan applicant's engineer and approved by the engineer for the Town.
EASEMENT
Authorization by the property owner for the use by another party of any designated part of his or her property for a specified purpose.
ENGINEER FOR THE TOWN
A professional engineer designated by the Town of Walworth Town Board to represent the Town of Walworth.
FINAL PLAT
A drawing, in final form, prepared in accordance with this chapter, containing all information and detail required by law and incorporating any stipulations of the Board.
FINAL PLAT PLAN APPLICATION
The submittal for final plat approval.
FLOODING
A rising and overflowing of a body of water onto normally dry land.

INFORMATIONAL MEETING APPLICATION
The first submittal prior to a concept application for a concept plan conference, if requested by the subdivider, presenting a very basic concept of the proposed project in sketch form showing the layout of the proposed project without the necessity to supply any further information, except as provided in § 151-5B(1).

INFORMATION MEETING CONFERENCE
An informal meeting between the Board and the subdivider to reach general agreement as to the basic form of the proposed layout of the subdivision. No formal vote will be taken on the proposed project. If, however, the majority of the members of the Board indicate they are favorably inclined toward the general layout of the project proposed, the subdivider shall take this as an indication that the applicant can either apply for a concept plan conference or preliminary subdivision approval, but in no event shall the subdivider take the Board's favorable inclination of the basic form of the proposed layout as an indication that either preliminary or final approval will be ultimately given.

LAND SURVEYOR
Any person duly licensed as a land surveyor by the Department of Education of the State of New York who has an exemption to certify the design of facilities to serve subdivision development pursuant to § 7208, Subdivision n, of the Education Law.
LETTER OF CREDIT
An instrument issued by a bank authorizing the Town to make drafts up to a specified amount upon the issuer.
LOCAL STREET
A street whose principal purpose is to provide vehicular access to and from residences and commercial and industrial facilities and to no-outlet streets, collector streets or arterial roads.

LOT, PARCEL, PLOT or SITE
Land identified by a legal description and/or tax account number which is filed or proposed to be filed in the County Clerk's Office or a parcel that is designated by lease lines.
NO-OUTLET STREET
A local street with a single access point to another public street.

PLAT
A drawing showing the layout of a proposed development of land.[3]
PREAPPLICATION SITE PLAN CONFERENCE
An informal meeting between the Board and site plan applicant for the purpose of allowing the site plan applicant to inform the Board of his or her proposal prior to the preparation of a detailed site plan and to allow the Board to review the basic site plan concept, advise the applicant of potential problems and concerns and to provide the site plan applicant with general information to be required for the site plan.
PRELIMINARY PLAT
A drawing, dated and clearly marked "PRELIMINARY PLAT," showing the layout of a proposed subdivision prepared according to this chapter and the Construction Specifications and Design Standards of the Town of Walworth.[4]
PRELIMINARY PLAT PLAN APPLICATION
The submittal for preliminary plat approval.
PROFESSIONAL ENGINEER
Any person duly licensed as a professional engineer by the Education Department of the State of New York.
RESUBDIVISION
A change in a map of an approved or filed subdivision plan if such change affects any street layout or area reserved for public use or any change of lot line. If the proposed "resubdivision" consists solely of the simple alteration of lot lines, then normal subdivision procedures may be waived at the discretion of the Board, provided that the criteria for waiver of normal subdivision procedures as prescribed in this chapter are met.
SITE PLAN
A drawing showing plans, sections, profiles and details of a business development, industrial development or one-lot residential property or other development permitted by the Code of the Town of Walworth and prepared in a manner as prescribed in this chapter.
SITE PLAN APPLICANT
Any person, firm, corporation, partnership or association which proposes a site plan.
STREET
A way, formally dedicated to public use, from which the principal means of access to abutting property is obtained.
STREET PAVEMENT
The improved wearing surface of the roadway used for vehicular purposes.
SUBDIVIDER
Any person, firm, corporation, partnership, association or other entity which proposes to subdivide the land.
SUBDIVISION
The division of any parcel of land situate within the Town of Walworth into two or more lots, parcel, plots or sites, with or without streets or highways, described by metes and bounds or by reference to a map with numbered lots or survey of the property or by any other methods of description for the purpose of sale, lease, license or any other reason. The term includes resubdivision and shall relate to the process of subdividing or to the land subdivided.
TOWN
The Town of Walworth.
TOWN BOARD
The Town Board of the Town of Walworth.
TOWN CONSTRUCTION SPECIFICATIONS
The Town document presenting official Walworth specifications for the construction of developments.[5]
TOWN DESIGN STANDARDS
The Town document presenting official Walworth standards for the design of developments.[6]
