The Borough Council of the Borough of Jenkintown, in order to
alleviate and lessen the pollution of the air by the discharge into
it of smoke, soot and ash, and thereby to further and improve the
public health and welfare, does hereby enact and ordain as follows.
From and after the effective date of this article, it shall
be unlawful for any person, firm, partnership, corporation or other
association to burn trash, lumber, leaves, garbage, straw or any other
combustible material in any yard, vacant lot or open area in the Borough
of Jenkintown; provided, nevertheless, that such prohibition shall
not apply to the burning of coals or similar material for the purpose
of cooking or preparing food for human consumption.

When requested by officials of the school district of the Borough
of Jenkintown, the Fire Marshal may issue a license under such conditions
as he may impose to burn lumber at a student rally situate upon school
property.
The Fire Marshal, Assistant Fire Marshal and police officers
of the Borough shall be responsible for the enforcement of this article.

Any person, firm, partnership, corporation or other association
which shall violate any of the provisions of this article shall be
liable, upon conviction thereof, to a penalty not in excess of $1,000
or to imprisonment for a period not to exceed 30 days, or both, for
each offense. Those enforcing this article shall be empowered to issue
a citation to any violator, bearing a penalty of $5 if paid within
72 hours of issuance and, if not so paid, then to be heard before
a Magisterial District Judge and, upon conviction, to be subject to
such penalty under the provisions of this article as he shall impose.
Such penalties shall be collected as like penalties are now by law
collected.
