As used in this chapter, the following terms shall have the meanings
indicated:
Any gun or other device which is designed for or which may be used
for the discharge and propulsion of a missile or projectile as a result of
utilizing air under pressure from a pump or other means.
Any pistol, rifle, revolver, shot gun or any other device which is
designed for or which may be used for the discharge and propulsion of a bullet,
cartridge, shell, shot or any other projectile by means of the burning or
explosion of gun powder or any other explosive.
Sling shots or any other implement which propels any object by force.[1]
The use or discharge of any instrument, including, but not limited to,
all types of firearms, high-powered sling shots, air guns, cross bows or similar
devices (excluding bows or compound bows) is prohibited.
A.
This chapter shall not apply to constables, sheriffs, prison
or jail wardens or their deputies, policemen of the Commonwealth of Pennsylvania
or its political subdivisions or other law enforcement officers or of the
National Guard or of organized reserves while on duty or other legally enrolled
members of any organization duly authorized to discharge firearms at any funeral
or other ceremony; or to officers or employees of the United States of America.
B.
This chapter shall not apply to any owner or lessor of property
in the Township of Kilbuck discharging firearms in destruction of predatory
animals, or to any bona fide and duly organized gun or sportsman club provided
a permit is obtained from the Kilbuck Township Police Department for this
purpose.
Any persons violating any provisions of this chapter shall, upon conviction
thereof before the District Justice, be sentenced in accordance with applicable
Pennsylvania statutes. Each and every violation shall be considered as a distinct
and separate offense.
