The police officers of the Township of Kilbuck shall strictly enforce
the Pennsylvania Motor Vehicle Code and the Pennsylvania Crimes Code and any and all other legislative enactments concerning and relating
to the use and enjoyment of a park situate in the Township of Kilbuck.
A. There shall be no molestation of any animals or birds.
B. Wading, swimming, fishing and bathing is forbidden in
any fountain or stream.
C. No person shall clean, polish, grease, lubricate or make
repairs to any vehicle.
D. Dogs, cats, horses or any other domesticated animals
are not permitted in the park.
E. No alcoholic beverages and/or drugs (as said term is
defined in the Pennsylvania Drug and Alcohol Abuse Control Act) are permitted in any park.
F. No weapons, including but not being limited to slingshots,
BB guns, firearms, bows and arrows, shall be permitted in any park, except
by any authorized law enforcement officer.
G. Each park shall close at 10:00 p.m. and open at sunrise
and no person shall be in the park while the same is closed, except authorized
park personnel.
H. There shall be no public meetings, assemblages or parades.
I. Goods, wares and merchandise, and services, shall not
be sold and/or leased in any park.
J. Games, contests and sports events are permitted only
in designated areas.
K. Picnics shall be held only in designated locations and
all picnickers shall be responsible to clean up the picnic area and to place
all waste matter in receptacles for that purpose.
L. Picnic areas and other recreational areas may be reserved
in accordance with rules and regulations adopted by the governing boards of
any park.
M. No person shall operate any vehicle in excess of 10 miles
per hour, nor shall they operate the same in a reckless or negligent manner.
N. Parking shall be permitted only in the areas designated
therefor.
O. A stop sign must be erected at each park exit.
P. No power-driven scooters, motorcycles, bicycle or vehicles
of any nature whatsoever are permitted beyond the parking area, unless specifically
authorized by park management and/or the police.
Q. Trees shall not be damaged, flowers shall not be dug
or cut, and fallen trees shall not be cut and/or removed; provided, however,
that in the event of an emergency situation, the ACORD Board may permit any
of the within to be performed by authorized individuals.
R. Metal detectors shall not be utilized for the purpose
of recovery of any buried object.
These rules and regulations shall be posted at conspicuous places in
the park recreational ground.
Any police officer when displaying a badge or sign of authority may
arrest upon view any person violating any of these rules and such police officer
shall forthwith file with the District Justice an information citing the violator
with said violation.
Any person who violates or permits a violation of this chapter shall,
upon being found liable therefor in a civil enforcement proceeding commenced
by the Township before a District Justice, pay a fine of not less than $100
nor more than $600, plus all court costs, including reasonable attorney's
fees, incurred by the Township in the enforcement of this chapter. No judgment
shall be imposed until the date of the determination of the violation by the
District Justice. If the defendant neither pays nor timely appeals the judgment,
the Township may enforce the judgment pursuant to the applicable Rules of
Civil Procedure. Each day a violation exists shall constitute a separate offense.
Further, the appropriate officers or agents of the Township are hereby authorized
to seek equitable relief, including injunction, to enforce compliance herewith.
