The provisions of N.J.A.C. 8:26-1.1 et seq. shall apply in the Township
of Pennsauken to the design, construction and installation of public swimming
pools.
No person shall construct or make changes in any swimming pool or bathing
area, including the buildings, structures, premises, beaches and appurtenances
used in connection therewith, if such changes are of a nature which may affect
the public health, until such plans and specifications therefor shall first
have been submitted to and approved by the Board of Health. When granting
such approval, the Board may stipulate such modifications or conditions as
it deems that the public health may require.
No person shall operate or maintain any swimming pool or bathing area
without a written license from the Board of Health, on a form prescribed by
it, to be issued subject to the provisions of the N.J.A.C. 8:26-1.1 et seq.
referred to herein and such additional sanitary safeguards in respect to the
particular premises to be so used as the Board deems that the public health
may require. Such license shall state the method of disinfection and treatment
of the water which shall be used by the owners and operators and the maximum
number of persons who will be allowed to use the pool or beach at any one
time and during any bathing period. The license shall be posted conspicuously
at the pool and may be revoked for cause by the Board of Health for violation
of the terms of the N.J.A.C. 8:26-1.1 et seq. and the additional sanitary
safeguards prescribed by the Board in granting the license.
Any person who violates or fails or neglects to comply with any provision
of this chapter or N.J.A.C. 8:26-1.1 et seq. referred to herein or of a notice
issued pursuant thereto shall, upon conviction thereof, be liable to a penalty
of not less than $5 nor more than $500 for each violation.
