It shall be unlawful for any person, firm, corporation
or the agent or servant thereof to dump or otherwise deposit litter,
garbage or refuse on any land, vacant or occupied, within the Borough,
except under written permit of the Board of Health.
As used in this article, the following terms
shall have the meanings indicated:
GARBAGE
The meat and vegetable waste solids and liquids resulting
from the handling, preparation, cooking and consumption of foods,
and includes cans, glasses, bottles and other containers in which
food has been preserved for consumption. The term shall also be deemed
to include offal and any other decaying or vegetable substance.
REFUSE
Embraces all other waste and includes, but is not limited
to, the following: paper, cardboard, books, plastics, bags, rags,
old clothes, leather, rubber, carpets, wood, excelsior, sawdust, tree
branches, furniture, vehicles, ashes, cinders, metal shavings, wire,
tin cans, glass, crockery and similar materials, cartons, boxes, manure
and the wastes resulting from building construction or alteration
work.
Every person desiring to dump or otherwise deposit
garbage, litter or refuse within the Borough shall apply, in writing,
to the Board of Health for permission to do so, the application to
state the name and address of the applicant, the type and quantity
of garbage or refuse to be handled and the specific location of the
intended dumping or deposit. No permit shall be granted unless the
applicant shall have satisfied the Board that the intended action
will not create a hazard to health or safety or property. The applicant
shall also satisfy the Board that any action will not be in violation
of any laws or codes of any governmental body or entity.
Any person who violates any provision of this
article shall, upon conviction, be subject to one or more of the following:
imprisonment in the county jail for a term not exceeding 90 days or
by a fine not exceeding $1,000 or by a period of community service
not exceeding 90 days.
This article shall be enforced by the Health
Officer, members of the Police Department, Construction Code Official
and Zoning Officer.
