Whenever the Township Committee shall find, by resolution, that
any building, wall or other structure is or may become dangerous to
life or health or might tend to extend a conflagration, it may, by
the same resolution, command one or more of its officers, to be named
therein, to remove or destroy the same, as in its discretion shall
seem more for the public interest, and may provide for the assessment
of the cost thereof as a municipal lien against the premises.
In the event that the Township Committee shall, by resolution,
provide that the cost of removal or destruction of any such building,
wall or other structure shall be assessed as a municipal lien against
the premises, it shall, by resolution, appoint a Board of Assessment
Commissioners in the manner provided by law.
No officer, anything herein contained to the contrary notwithstanding,
shall remove or destroy or attempt to remove or destroy any building,
wall or other structure until the notice required by law shall have
been given and proved as required by law.
When the provisions of this chapter and of law applicable hereto
shall have been complied with, any officer or officers commanded by
resolution of the Township Committee so to do shall remove or destroy,
as such resolution shall direct, such building or buildings, wall
or walls, structure or structures as shall have theretofore been found
by the Township Committee to be or to be likely to become dangerous
to life or health or likely to tend to extend a conflagration.
Any officer executing the command of the Township Committee
to remove or destroy a building, wall or structure as aforesaid shall
keep an accurate account of the cost and expense thereof and, upon
the execution of said command, shall file with the Township Clerk,
in duplicate, a true statement under oath or affirmation within 10
days.
If the Township Committee shall have resolved to assess the
cost of any such removal or destruction as a municipal lien against
the premises, the duplicate copy of the verified statement of the
cost shall be delivered to the Board of Assessment Commissioners,
which shall, upon receipt thereof, proceed according to law.
