For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
ANIMAL
Any domesticated dog or cat or house pet, four-legged and nonswimming or nonflying, which is oriented to an outside environment, but not including livestock or other farm animals or game animals subject to control by the State Game Commission.

ANIMAL SHELTER
A structure constructed by the Township to provide temporary boarding and care for animals described herein and subject to Township regulations.
BOARDING FEE
A fee established by ordinance to defray the daily cost of housing animals in the animal shelter.
CONTRACT
A legal document, authorized by the Township Council, whereby the Township provides only boarding services or full animal control services to adjacent municipalities.
DISPOSAL AND EUTHANASIA FEE
A fee established by ordinance to defray the cost of the Township of humane disposal of unclaimed animals.
REDEMPTION
The reclaiming of an animal confined in the animal shelter by its owner upon presentation of proof of possession by license or other documentation.
REDEMPTION FEE
A minimum fee established by ordinance to defray boarding cost and processing cost during the period an animal is confined in the animal shelter, including the time from which the animal was picked up by the Animal Control Officer up to 24 hours, after which an additional daily boarding fee shall be charged.
SALE
The sale of any unclaimed animal confined in the animal shelter up to seven days, not reclaimed by the owner if known, or other party in lieu of submitting the animal to euthanasia, following purchase of a license where applicable.

The following fees are hereby established, which are payable to the Township of Franklin Animal Shelter and which shall be deposited in the Township Trust fund to defray the cost of the animal control operations. No animal shall be released by the Animal Control Officer until all appropriate fees and license cost, if applicable, shall have been paid and a receipt issued by the Animal Shelter.
A.

A. 
Requested pickup fees and dead animal fees do not apply to stray dogs or persons finding and/or reporting stray dogs to the Animal Control Officer.
B. 
Requested pickup fee applies to animal owners who request the Animal Control Officer to pick up an animal at their residence or bring their own animal to the municipal animal shelter.
Immunization must be obtained and license fees shall be paid to the Clerk before an animal is released from the animal shelter.

A. 
Municipal boarding service fees shall apply uniformly in all contracts which establish such services with adjacent municipalities.
B. 
Those municipalities serviced by the Township shall transport all animals to the Township animal shelter with their own transportation.
C. 
The contracting municipality shall pay the daily boarding fee and disposal and euthanasia fee only in the event that the owner, when known, fails to reclaim the animal or when the owner is not known and the animal is not sold or disposed of by other humane means. Whenever the owner reclaims the animal, all fees shall be paid by him and not the contracting municipality.
D. 
Whenever an animal from a contracting municipality is adopted, all pertinent fees shall be deposited with the Township.
A. 
The rates established herein shall apply whenever the Township and any adjacent municipality or municipalities shall agree to contract for complete animal control service, including pickup, care, reclamation, disposal and allied functions, for the entire municipality not having its own animal control officer or animal shelter.
B. 
The administrative fee established herein includes overtime, social security, administrative and general fringe benefits and equipment use expenses.
C. 
The maintenance fee established herein includes cost of gas, grease, oil, other vehicle expenses and building maintenance expenses.
D. 
The fees established herein are base fees, subject to annual review by the contracting parties, and may be amended by amending the basic contract only to reflect cost-of-living and other inflationary increments. These fees are not all inclusive, and any specific contract drawn under this section may contain provisions relating to additional fees.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be subject to the penalties provided in Chapter 1, Article II, General Penalty, at the discretion of the court. Every day that a violation continues after due notice has been served, in accordance with the terms and provisions hereof, shall be deemed a separate offense.
