As used in this chapter, the following terms shall have the meanings
indicated:
BULK WASTE
Large items of refuse, including but not limited to appliances, furniture,
trees, branches and stumps, large auto parts, and construction and remodeling
waste which cannot be handled by normal municipal waste processing, collection
or disposal methods.
GARBAGE
Cans, bottles, food containers, plastic containers, clothing, and
other such matter, newspapers and magazines, refuse from animal, grain, fruit
or vegetable matter, and any other such matter.
HAZARDOUS WASTE
Any waste substance or material designated as a hazardous substance
pursuant to Section 7-201 et seq. of the Environment Article of the Annotated
Code of Maryland.
MUNICIPAL SOLID WASTE
Garbage and other discarded materials, including but not limited
to solid, semisolid, liquid and contained gaseous materials resulting from
municipal, and residential activities, which can be handled by normal municipal
waste processing, collection or disposal methods.
YARD WASTE
Grass cuttings, leaves, shrub clippings, flowers, small plants, and
branches two inches in circumference or smaller.
All municipal solid waste shall be placed along the collection routes
not earlier than 6:00 p.m. in the evening prior to the scheduled pickup date.
All industrial and commercial users requiring one cubic yard or more
of garbage or trash per scheduled pickup shall be charged for the service
pickup.
Any user producing hazardous waste shall be fully responsible for its
proper disposal as required by local, state, or federal laws and at its own
expense.
No waste produced or accumulated outside the corporate limits of the
Town shall be deposited within the corporate limits of the Town.
The Mayor and Council may establish regulations regarding the collection
or disposal of waste, including municipal solid waste, bulk waste, yard waste,
and recyclables. Upon approval by resolution of the Mayor and Council, any
such regulation shall have the force and effect of law, and any violation
thereof is declared to be a municipal infraction. The penalty for violation
shall be a fine of $50 for the first offense, and $150 for each subsequent
offense. These regulations may include, among other subjects, the days and
hours and routes for collection of waste, including recyclables; the specifications
for solid waste containers and recycling bins, and the times and manner in
which they shall be set out for pickup of the contents thereof by the collectors;
the removal of such containers after they have been emptied; prohibitions
of the mixture of certain types of solid waste in any one container; prohibitions
of the disposal of certain items; limits on the amount of solid waste or the
number of containers that may be set out for any one premises at any one time;
the imposition of reasonable fees to cover the costs of the administration
of the chapter; and such other matters as may be deemed appropriate. Copies
of any such regulations shall be maintained in the Town office for inspection
during regular business hours.
