A. 
It is unlawful to park, store or leave any vehicle of any kind, whether attended or not, or for the owner of any vehicle of any kind to allow, permit or suffer the same to be parked, stored or left, whether attended or not, upon any public or private property in the Town other than public highways without the consent of the owner of such public or private property, and the appointed Town official or agent is authorized to remove and impound any such vehicle. In any prosecution under this section, proof that a vehicle was parked, stored or left on public or private property shall be prima facie evidence that the vehicle was so parked, stored or left without the consent of the owner of such public or private property.
B. 
If the owner fails to repossess such vehicle within 30 days after it is impounded, such vehicle may be sold by the Town at public auction. The proceeds of such sale, after payment of the cost thereof, shall be applied first to reimbursing the Town or its agent for the cost of removing or towing the vehicle and of storing the same; second, to the payment of all liens on the vehicle, and the balance to be paid to the owner if claimed by him or her within six months of the date of sale. If the owner fails to claim such balance within this period of time, all remaining funds shall be forfeited and paid into the Treasury.

It is unlawful to park, store or leave any vehicle, the certificate of title, registration card or registration plate of which has expired, been revoked, canceled or suspended, or for the owner of any such vehicle to allow, permit or suffer for the owner of any such vehicle to allow, permit or suffer the same to be parked, stored or left, whether attended or not, upon any public street, highway, alley or parking lot within the corporate limits of the Town for a period longer than 24 hours.

If the owner fails to repossess such vehicle within 30 days after it is impounded, such vehicle may be sold by the Town at public auction. It is unlawful for any person to park, store, leave or permit any vehicle, the certificate of title, registration card or registration plate of which has expired or any motor vehicle which, though validly licensed, is not operable or in running condition for more than 30 days on private property within the corporate limits of the Town of New Windsor, unless the motor vehicle is totally enclosed within a garage structure consisting of a foundation, all sides closed and a roof.
B. 
This section shall have no application to licensed garages, body shops, vehicle agencies or in commercially and industrially zoned storage areas.
C. 
When a motor vehicle is in violation of Subsection A of this section the Town shall give notice of certified mail to the owner of the property and the owner of the motor vehicle and by posting a notice on the vehicle, which notice shall be effective, as of the date of mailing of the notice to the property owner. If the vehicle is not removed within 15 days of the mailing of the notice, the appointed Town official or agent is authorized to impound the vehicle.
D.

Whenever an appointed Town official or agent is authorized by this chapter to impound a vehicle, it may take possession of and remove any such motor vehicle and may cause such vehicle to be stored upon private property by suitable contract. The cost of removing or towing any such vehicle and of the storing of same must be paid by the owner before the vehicle will be released. Such charges are in addition to any fine or other penalty imposed for violation of this article.
Any violation of this article shall be a municipal infraction. The penalty for violation shall be a fine of $50 and each day upon which a violation occurs shall be a separate offense.
