There is hereby established and created in the
government of the Borough of Emerson a department which shall be known
as the "Department of Parks, Playgrounds and Recreation."
The Department of Parks, Playgrounds and Recreation
shall oversee the management, maintenance and regulation of the public
parks and playgrounds of the Borough of Emerson and with the direction
of public recreation carried on within said parks and playgrounds.

The Department of Parks, Playgrounds and Recreation
shall be under the supervision of a Commission, consisting of seven
persons, to be known as the regular "Recreation Commission." Said
Commission shall consist of residents of the Borough of Emerson, all
appointed by the Mayor in accordance with N.J.S.A. 40:12-1 et seq.
In addition, the Mayor and Council may, by ordinance or resolution
as appropriate, provide for the appointment of two alternate members.
Alternate members shall be appointed by the Mayor with the consent
of the Council, and shall be designated at the time of appointment
as "Alternate No. 1" and "Alternate No. 2." Alternate members may
participate in the discussions of the proceedings, but may not vote
except in the absence or disqualification of a regular member of the
Recreation Commission. A vote may not be delayed in order that a regular
member may vote instead of an alternate member. In the event that
a choice must be made as to which alternate member is to vote, Alternate
No. 1 shall vote.

A. The seven Commissioners first appointed shall be appointed
for terms of one, two, three, four, four, five and five years, respectively,
in such manner that the term of at least one Commissioner and not
more than two Commissioners shall expire in each year according to
the number appointed by the Mayor. Thereafter, all appointments shall
be for the term of five years. The alternates shall be appointed for
terms of one year and two years, respectively, and thereafter the
alternates shall be appointed for terms of five years.
B. Vacant unexpired terms of regular and alternate members
may be filled for the unexpired term of the vacancy only. The members
shall serve until their respective successors are appointed and shall
qualify.

C. No Commissioner shall receive any compensation.
D. Nothing in this chapter is intended to
be inconsistent with N.J.S.A. 40:12-1 et seq. Any inconsistency in
this chapter with N.J.S.A. 40:12-1 et seq. shall be deemed void and
unenforceable.

The Commissioners shall have the power to adopt
rules, regulations and bylaws for the proper conduct of their duties,
all of which shall be submitted for review and approval to the Mayor
and Council of the Borough of Emerson prior to being adopted by the
Commission. In the absence of bylaws, Robert's Rules of Order shall
apply.
Said Department shall annually submit a budget
for its expenses to the Mayor and Council for its approval not later
than December 31 of the year next preceding the year for which the
budget is requested. The Department may also solicit and receive any
gifts, bequests, donations, money or personal property which is to
be used for the purposes of the Department. The Department shall periodically
make a full and complete report, including an accounting, to the Mayor
and Council of the Borough of Emerson.
All maintenance and repairs of any public park
or playground shall henceforth be performed by the Department for
the management, maintenance and repair of all public property of said
Borough.
