As used in this chapter, the following terms
shall have the meanings indicated:
FIRE CHIEF
The Chief of the Emerson Volunteer Fire Department.
HOTEL
Every building coming within the classification of "hotel"
under N.J.S.A. 55:13A-3, and every building kept, used, maintained,
advertised as or held out to be a place where sleeping accommodations
are supplied and where meals are served in said sleeping accommodations
and other services rendered, all for pay, to transient or permanent
guests, having less than 15 rooms, furnished or unfurnished, for or
used for sleeping purposes and the rendition of the above services
for the accommodation of such guests.

PERSON
Any individual, partnership, corporation or association conducting
or intending to conduct a hotel or tourist house.
REGISTER
A bound book in which shall be entered, in ink, in the handwriting
of any guest, transient, tourist or traveler, or someone under his
or her direction, his or her full and true name, address and the state
license or registration number of any motor vehicle being used or
operated by such registrant or registrants; and, in addition thereto,
in ink, there shall also be entered in said register chronologically
and opposite to each registration the number of the room assigned
and occupied, the date and hour of registration and the date and hour
of departure of said registrant or registrants.
TOURIST HOUSE
A building in which sleeping accommodations only are furnished
for pay to transients, tourists or travelers and no meals are served
or other room service is rendered to such transients, tourists or
travelers in the room occupied by any such transient, tourist or traveler.

No person shall operate a hotel or tourist house
or hold himself out as operating a hotel or tourist house within the
limits of the Borough of Emerson without first obtaining a license
from the Borough of Emerson, as herein provided, and complying with
the provisions of this chapter, and, if a hotel within the definition
of N.J.S.A. 55:13A-3, without complying with all the provisions of
N.J.S.A. 55:13A-1 et seq.

Except when a hotel comes within the jurisdiction
of the New Jersey Bureau of Housing Inspection, the Fire Chief shall
have the authority and the duty to carry out the provisions of this
chapter with respect to any hotel or tourist house as herein defined,
and he is hereby authorized and empowered to adopt rules and regulations
consistent with the law and the provisions of this chapter for the
purpose of protecting life and property, and everyone operating a
hotel or tourist house shall fully comply with such rules and regulations.
Nothing in this chapter shall be construed to
abrogate or impair the power of the Board of Health of the Borough
of Emerson or prevent the enforcement of any municipal ordinance or
regulation not inconsistent with this chapter or to prevent or punish
violations thereof.
The license for such hotel or tourist house
shall be issued as of January 1 of each year and shall expire on the
December 31 following, and if such license is granted after July 1
of any year, such fee shall be 1/2 thereof.

The annual fee for such license shall be $400.
The person conducting such hotel or tourist
house shall keep a register as herein defined, which shall always
be available at any hour of the day or night to any police officer
of the Borough of Emerson.
It shall be the duty of the Police Department
of the Borough of Emerson to inspect the licensed premises from time
to time, at any hour of the day or night, to determine that the provisions
of this chapter are being complied with.

Any person violating any of the provisions of
this chapter shall, in addition to the suspension or revocation of
the license hereinbefore mentioned, be punishable by a fine not exceeding
$500 or imprisonment in the county jail for a term not exceeding 90
days, or both such fine and imprisonment, and every day of such violation
shall be deemed and taken to be a separate and distinct offense.
All ordinances inconsistent with this chapter
are hereby repealed, and an ordinance entitled "An Ordinance to License
and Regulate Hotels in the Borough of Emerson, Bergen County, New
Jersey," passed December 26, 1950, is expressly repealed.
