The provisions of this Article imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided. Emergency vehicles are exempted from this article at all times.
The Police Department is authorized to remove and tow away, or have removed and towed away, any motor vehicle parked in violation of this chapter. Vehicles so towed shall be stored in a safe location and shall be restored to the owner or operator upon payment of the towing fee and any incurred storage fees. The Police Department may have the towing performed by a commercial towing service requested by the owner/operator of the motor vehicle or a service duly authorized by the governing body through ordinance. Towing and storage fees for authorized commercial towing services will be set forth by ordinance also. Such fees are in addition to and not in lieu of fines set forth in § 274-2 of this chapter.
A. 
Parking prohibited upon posting of notice. It shall be unlawful for any person to park or leave standing any vehicle on lands of another, whether publicly or privately owned, in the Borough of Emerson, after notice has been posted as hereinafter provided by the owner, occupant, lessee or licensee prohibiting such parking. Nothing herein contained shall apply to any lands lying within the bounds of any public street or highway.
B. 
Signs to be displayed. Suitable signs shall be conspicuously displayed and posted on said lands by the owner, occupant, lessee or licensee thereof where this section is effective. Each sign shall conform to the size, shape, color and design pattern as stated in the Manual on Uniform Traffic Control Devices for Streets and Highways, as published by the United States Department of Transportation, Federal Highway Administration, and shall bear the words of the prohibited act. Prior to posting or displaying the same, the signs shall be submitted to the Emerson Chief of Police for review and shall be approved by him if they conform to the manual aforesaid. Defacing, tampering with or damaging such signs when posted shall constitute a violation of this chapter.

A. 
All designated fire zones within the Borough of Emerson, whether publicly or privately owned, shall be designated and marked in yellow as required by the New Jersey Department of Transportation.
B. 
In those areas where curb markings are frequently obliterated by accumulations of snow and ice, then curb markings shall be accompanied by standard signs which shall meet the specifications established by the New Jersey Department of Transportation.
Parking spaces shall be properly marked and defined as required by the Manual on Uniform Traffic Control Devices. Wherever there are such markings designating parking spaces on the pavement of any street, municipal property, municipally leased property or quasi-public property, each vehicle shall park within those markings. It shall be unlawful and a violation of this chapter for any vehicle to park across such markings or to park a vehicle in such a position that it will not be entirely within the area designated by such markings.
No person shall park a vehicle in a parking zone described in Schedule XIII (§ 274-49), attached to and made a part of this chapter, unless such vehicle bears a lawfully issued permit to park in parking spaces reserved for handicapped persons.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XIV (§ 274-50), attached to and made a part of this chapter.

A. 
All vehicles. No person shall park a vehicle between the hours specified in Schedule XV (§ 274-51) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule attached to and made a part of this chapter.

B. 
Commercial vehicles.
(1) 
Commercial vehicles as defined herein may not be parked on any street located within the Borough between the hours of 2:00 a.m. and 5:00 a.m. As utilized herein, the term "commercial vehicles" shall include the following:
(a) 
Step vans.
(b) 
Vans without side panel windows.
(c) 
Tandem rear pick-up trucks (four-wheel rear axel).
(d) 
Pickup trucks with steel or metal utility caps.
(e) 
Buses, including school buses and mini-school buses.
(f) 
Tractors or tractor-trailers.
(g) 
Any trailer or truck with a trailer.
(h) 
Camper vehicles and motor/mobile homes.
(i) 
Commuter vans or vehicles.
(j) 
Any stake-body truck, inclusive of pickup trucks with stake bodies.
(k) 
All dump trucks, regardless of size.
(l) 
Stretch limousines.
(m) 
All nonpassenger vehicles and/or equipment or machinery, including but not limited to construction vehicles.
(n) 
Boat trailers, with or without boats thereon.
(o) 
Any motor vehicle or trailer which is licensed or registered as a commercial vehicle under the laws of the State of New Jersey or is so registered in another state, district or territory.
(p) 
Any vehicle in excess of 9,999 pounds gross vehicle weight (GVW).
(2) 
The Chief of Police or his designee may exempt a vehicle from the restrictions described herein where said vehicle is owned by an individual who is present temporarily at a residence in the Borough of Emerson. Said exemption should only be granted where the vehicle cannot be parked on the property and shall not be granted more than two times per month to the same individual or same residence. Application to the Chief of Police shall be made in accordance with procedures to be established by the Chief.
(3) 
The Chief of Police or his designee may also grant a temporary exemption from the restrictions contained herein to residents of the Borough of Emerson upon proper application and where it is demonstrated that enforcement of these restrictions would create a hardship. Said exemption shall not be granted more than three times per month for the same residence.
No person shall stop or stand a vehicle during the times specified in Schedule XVI (§ 274-52) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule XVII (§ 274-53) at any time between the hours listed in said schedule of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
The locations described in Schedule XVIII (§ 274-54), attached to and made a part of this chapter, are hereby designated as loading zones.
The locations described in Schedule XIX (§ 274-55), attached to and made a part of this chapter, are hereby designated as taxi stands.
The locations described in Schedule XX (§ 274-56), attached to and made a part of this chapter, are hereby designated as bus stops. These designated locations are the only locations within the Borough of Emerson to be utilized by New Jersey Transit for the picking up and discharge of passengers. The designated bus stops shall be appropriately marked with signs and curb paintings in accordance with relevant state traffic control regulations. Passengers shall not be picked up or discharged at locations other than those described herein.

A. 
Thirty-eight parking spaces on Emerson Plaza East shall all be designated as reserved commuter parking. Thirty-six shall be designated as reserved commuter parking for an annual fee; and two spaces shall be designated as handicap commuter parking with restricted time limits. Emerson will continue to offer free commuter parking in other designated lots as defined in the Code of the Borough of Emerson.
B. 
Numbered commuter parking tags shall be issued on a yearly basis to 38 individuals who apply through the Emerson Police Department and who provide current vehicle registrations, proof of address and motor vehicle license plate numbers. The fee for a parking space shall be $250 for an Emerson resident and $600 annually for a nonresident. Emerson residents shall have the month of December to purchase/renew commuter parking tags on an annual basis, while nonresidents may apply for reserved commuter parking spaces after January 1. For the first year of this section (2014), Emerson residents shall have right of first refusal through March 2014 to purchase a reserved parking tag. Commuter parking tags shall be issued on a first-come-first-serve basis. A commuter parking tag is not transferrable for use by another undocumented vehicle; however, a commuter parking tag can be used in multiple motor vehicles as long as those motor vehicles are registered properly with the Emerson Police Department by the commuter under the same name and address as the commuter the tag is issued to. Any commuter parking tags that become available during the calendar year shall be offered first to Emerson residents maintained on a waiting list and prorated monthly up to the annual renewal period.
C. 
Reserved parking shall be between the hours of 5:00 a.m. and 7:00 p.m., Monday through Friday. Parking outside of the reserved time slots shall be on a first-come-first-serve basis. There will be no charge for parking outside of the designated reserved times.
D. 
Tags shall be sold at the Emerson Police Department and the transaction shall be conducted by the police dispatchers.
E. 
Nontagged vehicles parking in the reserved spaces within the reserved hours set forth by this section shall have their car towed immediately.
