Any person accepting work as a builder and/or contractor for the erection, construction, and/or alteration of any building or structure within the confines of the Township of Lower may apply for a construction permit only after obtaining all other required permits and approvals from any applicable federal, state, county, or municipal agency, as the case may be. For purposes of this section, the term "approvals" shall include, but not be limited to, any and all variances necessary pursuant to Chapter 400, Land Development, of the Code of the Township of Lower.
The provisions of this chapter shall apply to any person who shall engage
in the erection, construction or alteration of any building or structure within
the confines of the Township of Lower as a subcontractor of a residential
homeowner who is serving as his or her own general contractor.
Additionally, any person who shall engage in the erection, construction
or alteration of any building or structure within the confines of the Township
of Lower in any capacity other than as the person obtaining the construction
permit shall review and sign the subcode technical section of the permit as
proof that he, she or it has confirmed that such a permit was issued.
The Township Council may, in its sole discretion, suspend or revoke the license issued pursuant to Chapter 191, Builders and Contractors, Licensing of, of the Code of the Township of Lower held by any person or any entity who shall violate the terms of this chapter. Such suspension or revocation shall occur only after the following:
A.
The Township shall provide the violator with 10 days'
notice of an intention to suspend or revoke.
B.
The violator shall have the right to request a hearing
before the Township Council or a designated subcommittee thereof. Such subcommittee
may include the Township Manager and/or the Township Construction Official.
In addition to any penalty set forth in § 254-4 above, any person or entity who violates the provisions of this chapter shall be subject to a fine of no more than $300.
