Members of Council, the Mayor, the Auditors and the Personnel
Board shall have the power to authorize and conduct investigative
hearings in aid of the exercise of their powers and performance of
their duties.
The officers aforesaid, independently, may from time to time
adopt rules governing the hearing procedures.
The officers aforesaid may compel the attendance of witnesses
and the production of books, papers or other evidence, at investigative
hearings, and for that purpose may issue subpoenas signed by any of
the officers aforesaid, and cause the same to be served in any part
of the Commonwealth of Pennsylvania in accordance with general law
applying to the service of subpoenas.
The officer presiding at any hearing held pursuant to this article
shall have the power to administer oaths or affirmations to witnesses.
If any person shall refuse or neglect to obey any subpoena issued
by the officer, that person shall, upon conviction thereof at a summary
proceeding, be sentenced to pay a fine as may be ordained, and in
default of the payment of such fines and costs shall be imprisoned
not to exceed 30 days.
If any person shall refuse or neglect to obey any subpoena issued
by the officer, the officer may apply by petition to the Court of
Common Pleas for its subpoena, requiring the attendance of such persons
before the officer or the court.
